U.S. Court Blocks Anti-Telemarketing List

WASHINGTON (Reuters) - A U.S. court in Oklahoma has blocked the national "do not call" list that would allow consumers to stop most unwanted telephone sales calls, the Direct Marketing Association said on Wednesday.

The U.S. District Court in Oklahoma City said the Federal Trade Commission overstepped its authority when it set up the popular anti-telemarketing measure, according to the DMA.

The FTC had signed up some 50 million phone numbers for the list, which was due to take effect on Oct. 1.

we should have known this wouldnt hold up since the majority of people want it. I am on the list and still get 2 or 3 a day sometimes. I am getting to be really rude now.

i certainly hope this all goes away. i do not want gov intervention in no call lists. get caller id, get an unlisted #, or get an answerimg machine. this situation is going to lead to numerous ridiculous lawsuits. do you really want the courts tied up with more bs ? i have an unlisted #. it costs me 4 dollars a month and i never get calls from telemarketing groups. jmo

Won't last long--Another liberal judge appointed by Carter will get put in his place.
House voted 412-8 and senate 95-0 in favor of no call list and Bush should put his ok on it today.

--and the fence straddlers who abstained from voting

----Presidential material...... can't even make a decision on this issue

I tend to agree with elvis, but the fact is @50% of the phone owning homes in this country will end up wanting it, and as this is a government of, for and by the people, thats why you see action on it. I want people to be able to find me if they want to, so I dont want an unlisted #. But not having an unlisted number doesnt mean I give the telemarketers free reign to call me whenever they want.

Ironic that CNN ran a story about the judge who blocked it had put his name on the list.

And not that there needs to be a record of such thing, but it would have been at least 96-0 in the Senate. Senator Gregg missed the vote to attend his fathers funeral - his dad was an ex-NH governor and one of the real leaders in the NH Republican party.

Can you believe it? A federal judge says that the list is a violation of our free speech rights. So .. now free speech means that you have the right to call anyone you want and harass them at their home at a time of your choosing?

If a do not call list is a violation of this cherished right, then what about unlisted phone numbers? Hey, I want to call Barbra Streisand and tell her what I think of her mindless politics .. but her number is unlisted. Those unlisted phone numbers are a violation of my free speech rights ... and I want them outlawed! And what about those phones that reject calls from people who have their phone number blocked to people with caller ID? Are you telling me that I have to identify myself in order to have my free speech rights? Just where is THAT set forth in our Constitution?

We are truly losing it.

To be fair Stevie I post all the hyprocracies and judgements that I believe liberal judges have made issue on in past 6 months (if Jack has enough bandwidth) and you post the ones you think conservative judges have and we'll compare lists ;)
--or I could be briefer and to the point just by listing the ones the ACLU has petitioned--Defending MAMBLA (child porno site)-disallowing boy scouts to use public facilties to camp-no prayer in school-no pledge of allegiance-no military recruiters on campus and I won't get into the gay issues ect. You know, all the important issues those on the left advocate that make this country a better place to live--but for who??????????

To be fair DTB you should post ALL stupid judgements by whoever makes them. To bring up the name of four senators who missed a vote that went 95-0 is not fair. Their votes would not have made a difference the score was 95-0! I do not see how you can make this a liberal vs. conservative issue. Everyone who voted, both liberal and conservative, voted in favor of it. That would tell me that all Boy Scouts, whether they be gay or straight agree on this issue.

Coincidence? I don't think so but in your defense Stevie I would logically assume maybe they were in presidential debate or attending pertinant political function since all were absent.
Contrary to what you think I am not against all Democrats,mostly those with extreme left agenda's and while not quite as adamant I do not care for those rebs on the far right.
I think both try to shove their views in our faces. It should be a choice by the people in my view. Whether it be prayer-pledge of allegiance,national anthem or what ever. I don't think anyone should be forced to do it nor be forced not to do it.---but so far all the agenda's have been to disallow not give a choice.
