The casino calculated the risk and weighed the factors and made the decision not to pursue it based on that.

Whether they were technically and legally right or wrong is irrelevant.

Let's say they are legally right to get the money back - when you factor in the cost of trying to attain that money, it might balance out to zero. PLUS the added negative media attention it would have attracted and tarnishing the event in future years.

OR, they could say - ok, we asked for it back, they don't want to give it back and when you look at the overall amount, we don't want to run the risk of tainting the future moneyflow. We'll eat this loss because of the goodwill it will produce.
