question for judges or attorneys

A friend of mine was driving last week and lost control of her vehicle, resulting in the death of her younger sister. She was arrested on two felony counts and jailed in lieu of $50,000 bail.

The charges were: California VC 23153(a) Driving while intoxicated, and California PC 191.5(a) vehicular manslaughter while intoxicated.


Any ideas as to what kind of sentence she may be facing?? She's 21, and has a prior for simple assault.

I am no judge and no attorney but I have been listening attentively to loophole and Eddie Haskell and a few others for quite some time now.

Its a serious situation, no doubt about that.

She should not expect any favors from the court as I don't think any will be offered under the circumstances.

Just to begin with her sister was killed in a car she controlled while driving drunk. What a terrible life mistake to make at
21 years of age.

Just the trama of waking up everyday knowing that you were responsible for the killing of a sibling is hard for me to even fatham.

The worst case they could add on gross negligence.

The estimated maximum sentence would be 10 years in jail.

With good behavior she could be out in 5-7.

With the prior arrest she most likely will do the hard time.

What a terrible tragedy to read of.

God Bless that family. They will need much strength to get through this.

I am not sure how I would help a friend that
put themselves in that situation.

the judge is lenient...taking into account the terrible tragedy this family has suffered and maybe,not wanting to compound the anguish by putting the girl in prison....

the question,imo,would be the dui issue...i have no idea what kind of "wiggle room" a judge might have in a situation like this....

loop and eddie would be much better equipped to answer this question...they are the professionals.....

Have no idea what California law is like. In Ohio the intoxication factor would get an indictment of aggravated vehicular manslaughter. Although not a criminal lawyer, I think in Ohio its a felony 1, the highest level of felony.

If California is similar to Ohio (I can't believe I'm saying that), you better have your friends sister hire a pretty good lawyer. Best hope is that you draw a judge that considers the family and not wanting them to lose two daughters by imposing a long sentence.

I wish I could be of more help.

Thanks for the replies, guys.

Looks like her parents are gonna let her hang on this one. For what I gathered, she's been the "out of control" daughter that trouble just seems to follow. Unfortunately, another case of one being a product of their environment.

Since she'll more than likely have a public defender, would the judge be more likely to just follow the letter of the law at sentencing? What would be the best case/worse case scenario?

HUH????? It's a terrible tragedy and something she will regret and live with the rest of her life, but I'm guessing she knew right from wrong before she sat in that driver's seat. How is it anybody's fault but her own?
