John Kerry has repeatedly opposed efforts to limit the medical liability lawsuits that raise health care costs by as much as $108 billion dollars each year. Instead of working to lower health care costs for families, Kerry has proposed raising taxes to pay for a government-run health care program that shifts costs to taxpayers while empowering bureaucrats in Washington. Kerry should start taking the side of patients and doctors rather than the trial lawyers who have given him more money than any senator over the past 15 years."

All the lies and propoganda are working. When doctors and hospitals commit malpractice, the victim will lose. If one of you are the victims of malpractice and you vote for Bush, you will have no one to blame but yourselves when you go to a lawyer and he turns your case down.

Remember, everyone's lawsuit is frivolous, except mine. After the republicans have completely eroded your rights and have completed their plan to end malpractice cases, ask your doctor how much his premiums have decreased. I think we all know the answer to that one. No, wait, they won't need malpractice insurance because they will be immune from suit.

How nice it would be to chop off the wrong leg, look at your patient and say, boy, I'm sorry. But then again you have the other leg, so whats your problem. It would be nice to not be responsible for your actions. Yes, that is the same mantra that the medical profession and insurance industry have been using against victims. Wonderful how the spin works.

The insurance companies have raised malpractice premiums because the dot coms (in which they were heavily invested) blew up in the late nineties. Who could they blame? Why not everyones favorite target, the lawyers. Killing two birds with one stone.

I credit Carl Rove with getting a criminal in the white house and I credit the insurance industry in concert with the medical profession in destroying personal freedoms and the right to a jury trial guaranteed by the Constitution. As much as these things are destroying this country, I will give credit where credit is due.

Does Freeze have an agenda, of course. Are his premiums being raised, no doubt (especially considering the number of claims that have been probably made against him) Do I? You might think so but, I have not had any cases that approach the cap limits in this state. Personally, it hasn't had a direct effect on my practice.

The reality is that it is easier to con the masses with a well orchestrated public relations campaign based upon false, misleading and biased datat then it is too tell the truth. Target lawyers. Losses to the American people.

It's funny but 9-11 solidified the Bush regime in power and permitted this environment of patriot act, surveilance and loss of freedom to permeate the electorate. I fear that the real losses of 9-11 are far greater than the 3000 souls who lost their lives that day.

More class action lawsuits helping America by supporting terrorist.

"LOS ANGELES (Reuters) - Lawyers representing nine former Iraqi prisoners on Tuesday asked a federal judge in San Diego to ensure that U.S. defense contractor CACI International trains the interrogators it sends to Iraq (news - web sites) in international laws against torture.



The request for a preliminary injunction is the latest salvo in a class action lawsuit filed in June by the Center for Constitutional Rights in New York and two law firms on behalf of the former inmates at Abu Ghraib prison outside Baghdad who said they were tortured by American military personnel and private contractors.

As a result of litigation, we spend:

whats my agenda? my chosen profession in the medical field benefits from at least one of the above categories...

to be honest, because of potential outsourcing, which lawyers will protect indirectly so American doctors dont lose their jobs -- i still benefit

but it doesnt stop calling a spade a spade

I dont like insurance companies and i dont like lawyers and i dont like hospital administrators...i am a doctor and i do whats best for the patient and all 3 of those other problems create all kinds of hastles

and the patients ulitmately lose from all 3 of them....

the legal system is in no way "protecting" patients...that is plain BS.....99% of doctors do their best no matter what and the other 1% you cant fire because they countersue with their own lawyer.....

Lawyers make it nearly impossible to decertify bad doctors..that is a fact that no one can deny....some protection this offers the citizenry

If they would only tell the whole truth . That is both sides. It's such BS blaming it all on others then the failures of doctors that cause these law suites. And Kerry has a plan and it's not the best but it's a plan. Bush has nothing. And to just start giving even more away then asked for. And that is what this new law would do. That is even dumber.

If you read Doc's link you will note that insurance companys don't want the risk at ANY premium.There are only a handful that will write it.
and on your your presumption that Ins co raised premiums because they lost money on dot coms is even beyond liberal logic.
For you to get even your minions to believe that you would have to to assume that ins co only invested their proceeds from malpratice ins in dot coms and not their P&C premiums which in many areas rates had actually went down.
This will tell you why ins co are in same boat as medical profession.

And though he sues some individuals in other specialties repeatedly, he far more frequently sues and sues again the same OBs. "We concentrate on OB work because I like it," he says. "And it turns out that it's more lucrative." There's no cap on awards for pain and suffering in Washington, D.C. "So the return on those cases justifies the work that goes into them. We average $50,000 to $100,000 in expenses per case."

Yes Edward you would like for public to think you are the "little guy crusaders" but I have to believe Olender's motives are much more accurate--not saying that would apply to you but to PI's in general.

Again, neo-conservatives fighting to limit civil liberties at the altar of large corporations. This time it is the right to be fairly compensated following a medical practitioner's negligence.

Here is my question: Why do people who profess to want freedom from the taxes that limit one's financial freedom want to impose an artificial limit on the amount of money a person can be awarded when wronged by a doctor?

but justice is absolutely lost in what is going on now...

case in point: a guy has Atrial fibrilliation, a very common condition...some specialists will argue to use warfarin (rat poison) while some will not.....

this prevents throwing emboli which can kill you...well, side effect is intracranial hemmorrhage....

the literature is conflicting....but guess what? malpractice suits have been raised if you do or do not decide to use this......

is it a tragedy? yes....
is it malpractice? definitely not
do paid experts testify against other doctors? yes
are doctors damned if you do or damned if you dont? definitely

what is your solution to this mess lawyers have created?

what is your solution to John Edwards getting up in front of a jury telling them that "he feels like he is inside little Timmy" and that this kid with cerebral palsy needs lots of money to live now and only the doctor can provide milions of dollars? when the doctor had nothign to do with it!!!!!

what is a solution to this mess???????

i dont believein tort reform either...i dont like governmnet telling anyone what to do!!!!

but when outlaws are on the bench, former trial lawyers themselves...what are you supposed to do????

While I represent my client in court or as you would say "bantering" against doctors who have killed or seriously injured their patient, there is an advocate representing the doc who, generally is more than an adequate attorney. Yes, medical student Freeze, I think the world is grey. I think there is good and bad in everyone. Yes, even in you and Wayne. Sometimes, its just a little hard to find.

I know its tough for your young mind to grasp, but at one time in this country the white majority did consider blacks as bad. You see, medical student Freeze, about 150 years ago there was this thing called slavery. Slavery was when white people owned black people and sold them kinda like you might sell several heffers grazing down there on the south forty.

And about 50 years ago, just a little south and east of your trailer, they had white only restrooms, drinking fountains and lordy, lordy, black people or niggers as they were called back then had to ride on the back of the bus. Yeah, us white people kinda sorta thought black people were bad, sub-human and chattel.

With reference to your next point of light, your president, Bush that is, has been trying to get this little old marriage amendment added on to the Constitution. By the way, the Constitution is this document that was written a long long time ago (like star wars) that your president likes to ignore sometimes and then likes to invoke some times. Whenever it fits.

Someone who doesn't want to give gays equal rights and wants to legislate into the bedroom by just adding an amendment to the Constitution that states that marriage can only be had between a man and a woman might be considered by some, I know this is a stretch, as thinking gays are bad.

That anti-gay marriage amendment will look good next to amendments guaranteeing freedoms of speech, assembly, unlawful searchs and seizures and right to a jury trial. Oh yeah for you gun owners, right to bear arms. Yep, right up there in importance. It amazes me how people cannot see what a sicko, psycho, religous whack job we have in the white house.

Well, medical student Freeze, I am certainly taken aback by your criticism and vitriolic (I like that word) narrative. Since your solution to the medical malpractice crisis trumped up by your bretheren, excuse me, future bretheren and Wayne and the insurance minions, is to outlaw the personal rights of your patients, destroy their right to a jury trial, and in effective, make you and your bretheren, there I go again, future bretheren, immune for there negligent acts, may I humbly offer this alternative rationale.

You say we (lawyers) greedy. Medical student Freeze, there are two types of greed. One, and I assume you are referring to this, is when a person wants something for nothing. However, MSF, may I call you MSF? The second type of greed, is when you are responsible for something and refuse to pay it. I like to call this one back door greed. In other words, you hord your money although you negligently injured someone.

This is what the "greedy" doctors and insurance oompanies have done by creating a crisis, blaming it on the lawyers, then passing laws which will allow them to keep there money although they have committed negligence. You see, MSF, some might consider you back door greedy.

Lastly, I, and I assume John Edwards, have never said we don't want to get paid for what we do. To prove that you, excuse me, there I go again for the third time, doctors are negligent it takes at a minimum $20k out of the lawyers pocket to hire experts cause you guys............................ (Eddie looking frustrated with himself) ................. doctors............ in a geographic area will not testify against one another. Its not the couple of hundred dollars that you or someone else on this board indicated that that was all it took to prosecute a case.

We sometimes, and I mean sometimes, get paid for what we do. You, ................. Sometimes less than you ....... Edward Your commentary is about as logical as the gay rights activist carrying posters at the RNC that said "stop aids" when they are the largest contributor to aids.

While there are situtions where there is truely malpractice it would be much more efficient to have cases looked at and settled by arbitration--the same goes for class action lawsuits. Everyone still gets their day in court and even if settlement in valid case is somewhat smaller they still come out ahead by not having to fork over 1/3 or greater and cuts huge expenditures in other areas of the process.

To put things in perspective you can have insurers pay claims on catastophic events such as hurricanes and stay solvent and homeowners ins rates do not skyrocket--yet against the man made disaster of frivolous lawsuits most insureres don't want any part of it at any cost.
How would you like to pay E&O insurance of $100,000 a year.What % of doctors do you think commit malpractice and what % do you think is unjustly accused of it.
Now if you go to goggle search you will find this if you type in attorney--(Results 1 - 10 of about 9,360,000 for attorneys)

Now find me just one that specializes in litigation against other attorneys for frivilous lawsuits. Its a one way street. What recourse does a doctor or anyone have if they are falsely accused by con man and scrupulous attorney--other than to pay out the ass to (guess what) another attorney to defend him.
REGARDLESS of the outcome of even the most frivilous lawsuit your ALWAYS going to have at least one person make money--an attorney.
Now if they passed a law that in such cases the plaintiff's attorney had to pay for defendants legal fees in the most flagrant cases that would go a long way in curbing it--

Since you have correctly made the assumption that most personal injury cases are taken by the lawyer on a contingency fee why would that lawyer take on a case which he knows is frivolous.

Yes, Wayne, even you can do this math. 1/3 of nothing is nothing. Your anticipated argument that carriers will pay nuisance fees to make the suit go away is also false. Carriers do not pay for frivolous suits. The insurance counsel files motions for summary judgment which are readily granted by liberal judges.

Your arguments are not based in fact and, as usual, are just spin capitalizing on a popular bias against lawyers. According to you and MSF all you have to do is file a case and voila, the attorney is rich. That may be your fantasy but, I live in that world and I know reality.

You can cite Fox all you want but, I know what happens and you and the quack do not. I am in court 3 to 4 times a week, I know judges, juries and a lot of other lawyers both plaintiff and defense. I did insurance defense work the first 5 years of my practice and am too familiar with the carriers methods of claims resolution.

As I indicated earlier Allstate sent employees posing as engineers to the San Fernando valley to evaluate home damaged in a quake. They said many of the homes did not suffer foundation damage when in reality they had. Saved the stockholders a bunch of money until they got busted.

Yeah, I know all about your wonderful carriers who will soon be heading to Florida/Alabama to wonderfully resolve their insureds claims. So dont give me this crap about how great you are coming to the rescue of the homeowners.

The only thing you are great at is collecting premiums. Tell me how the contingeny fee lawyer makes money off of a frivolous lawsuit. You continue to lie and mislead.

Thank you for your prayers. Your right about my insults. I will have to tone that down. I also appreciate the fact that you and Wayne do not insult my profession. You always take the high road and never stoop to calling lawyers scum, parasites, vultures, predators, ambulance chasers and the like.
