Soldier has gay sex with Iraqi boy, then kills him

A North Carolina National Guard member thought to be the first U.S. soldier convicted of murdering an Iraqi said he "snapped" and shot the 17-year-old boy after they had consensual sex, according to court-martial records released this week.

Pvt. Federico Daniel Merida, 21, of Biscoe, a tiny town south of Asheboro, pleaded guilty during a court-martial in Iraq to shooting the Iraqi national guard private, whose name the Army withheld.

Merida was sentenced Sept. 25 to 25 years in prison and reduced in rank. He will be dishonorably discharged.

Army officials at Forward Operating Base Danger, where the court-martial was held, withheld details of the case, saying the records had to be approved by a general. They released the records to The News & Observer on Thursday.

Maj. Neal E. O'Brien said Army rules required that most of the names be inked out, including that of the victim. The Los Angeles Times reported shortly after the court-martial that the victim's name was Falah Zaggam.

According to the records, Zaggam and Merida were on guard duty May 11 in a tower on the perimeter of an Army camp near Tikrit in northern Iraq. About 10:30 p.m., Merida shot Zaggam repeatedly with his M-4 carbine.

The "gay panic" motive was the third that Merida offered. He first told investigators that Zaggam demanded money at gunpoint. Later, he said he killed Zaggam because the boy forced him to have sex.

Interviewed a third time by skeptical investigators, Merida said he got angry after the two had consensual sex. When the boy went to the latrine, Merida began to craft an excuse for killing him.

According to the records, Merida told investigators that he picked up Zaggam's AK-47 rifle and chambered a bullet so that it was ready to fire. He then pulled out the magazine, which held the rest of the bullets, and put it aside.

When Zaggam returned, Merida handed the gun back. Merida then grabbed the boy's trigger finger, forcing him to fire a bullet into the ceiling.

Merida then radioed the camp headquarters and said Zaggam had tried to kill him after demanding money. Merida dropped the radio and raised his own gun, a short version of the M-16 assault rifle.

Merida first shot at the floor of the guard tower, then into Zaggam's legs, according to an account that Merida signed for the court-martial. Zaggam tried to wrest away the rifle, and Merida shot him in the groin. Zaggam clutched at a railing and fell down the stairs as Merida kept shooting.

"The accused fired a couple more rounds into the lifeless body ... then took his magazine out and set it aside, put his weapon down, and called ... to report that he had just killed the [Iraqi national guard] soldier who had tried to rob him," the account signed by Merida said.

The boy was hit by 11 bullets.

In an agreement with the Army that limited his prison sentence to no more than 25 years, Merida pleaded not guilty to premeditated murder but guilty to murder without premeditation. He pleaded guilty to two counts of giving false statements in his initial explanations. He was found not guilty of dereliction of duty for having consensual sex while he should have been guarding the camp.

During the court-martial, Merida apologized to the victim's family.

"He was a son, a brother, someone very important to them," he said. "I took someone they loved and cared for."

Plea for leniency

Friends and family members wrote the Army asking for a reduction in Merida's sentence, citing the fact that his son, a toddler, needs him and that his wife speaks little English and relies on him. Merida was born in Veracruz, Mexico, and moved to the United States as a child.

A man who answered the phone at the family's home in Biscoe declined to identify himself or say whether the family had heard from Merida recently. "I don't know nothing, man," he said, and he hung up.

Merida is confined at Fort Leavenworth, Kan., a Leavenworth spokeswoman said.

Merida is a member of the 113th Field Artillery Battalion's Battery B, based in Monroe. He deployed to Iraq early this year with an N.C. National Guard brigade of several thousand soldiers, which was placed under command of the 1st Infantry Division.

Maj. Robert Carver, a spokesman at the N.C. National Guard's Raleigh headquarters, said Guard leaders here knew little about the case. He said that if there was anything positive about the unpleasant case it was that it should serve notice to Iraqis about how justice should work.

"Obviously one of the things we're trying to do in Iraq is foster an environment that includes the rule of law rather than dictatorship, and hopefully this demonstrates that to the Iraqis," he said. "The rule of law was applied, and the guilty have been punished."

Yet I have heard you tell us in previous threads how tolerant you are.

Please explain this paradigm.

Too bad the Iraqi kid didn't run into are Marine. The Kid would have gotten to be the pitcher and probaly got a few bucks out of the deal.

I have no animosity for real Christians who try to model there lives after Christ. Although I am not a believer, I think any religion, in moderation is a fine thing.

The problem is I don't see how your buddie in DC, who professes to be a Christian, models his life after Christ. Lets seperate true belief from rationalization/justification.

Radical fundamentalist Islam is identical to radical fundamentalist Christianity. Both are very dangerous and threatening to civilized society. To put it in black and white for you, both are evil.

I disagree with you as I am an imperfect Christian who "tries" to model his life after Christ but fails on an hourly basis.

As you can tell, I exhibit out of control anger, heartlessness, etc.etc. which are counter to the Christian faith.

And I view folks who as you would describe as intolerant fundamentalists with similar problems, some of which are unbeknownst to them as some of my problmes are unbeknownst to me.

And I try to look upon these folks with compassion as I attempt (once in a great while) to look at your disturbed political views with compassion. Although both anger me at times.

Radical fundamentalsim does not aim at terrorizing civilians, slaughtering missionary workers from other faiths or sects of their own faith, etc. etc. Maybe there are some cults -- as Mr. Jones decided to involve himself with -- and i agree that those folks involve themselves in evil. And mainstream Christianity --- which our man in DC has idenitified himself with -- does not come anywhere close to this in any way shap or form.

Secondly, I find it hard to fathom a guy, who encourages us to look at the Iraqi from his/her perspective, would be so critical of these folks without looking at them from their own perspective. It seems that you are a caring, understanding fellow -- always looking out for the little guy -- and as many of these Christians are in fact not the material achievers - as demographics will show -- you would be sympathetic to their plight. You, Reverend Haskill, are their only friend when they have no one left to lean on. You and Jesus, Mr. Haskill.

So Eddie, I wish you peace in return, and remember that Jesus is the reason for the season.

First of all, I am not a Reverend. Secondly, my political views are not disturbed. Rather, they are based in fact. My point is fundamentalist beliefs, of whatever nature, are dangerous and harmful to non-fundamentalists.

It is clear that you and I have a different perspective and manner in which we look at the world. With all due respect and not to offend, you are a black and white guy. I am a grey guy. Who's right. Both of us and neither of us.

Are flying planes into buildings, beheadings, and the death of hospital workers evil. Yes. Is the murder of an Iraqi teenager after sex, prisoner abuse and death, and killing wounded Iraqis evil. Yes.

Is the war in Iraq the right thing to do. You think so, I think not. I hope one day you will see that "terrorizing civilians" can be applied to our military's actions in invading Iraq. It cuts both ways. Hence, my greyness.

I know you are sarcastically saying I'm looking out for the little guy. Do you realize that I can say the same about you (I assume your a student) after you get out of medical school, do your residency, and begin a private practice making a nice six figure income. Frankly Doctor, I know many in your profession whose primary interest is the bottom line and not helping the little guy.

Once again Doctor, its very grey. I like to make money from practicing law. It really is neat when I can make money and help the little guy. But please, stop your holier than thou attitude until you hook up with Doctors without Borders and start treating those in Darfur.

When you do that, let me know, and I will do pro bono work for the legal aid society.

Eddie, I believe now would be a good time to set up the Haskill - Freeze charity foundation.

We will give to great causes as fighting hunger and AIDS in Africa, provide heatlh care to kids in our country, and re-elect conservatives who will alow us delegate our money as we see fit and not waste it on some government program or fund DJV's internet connection so he can bitch and moan until he is 100.

Together we can do it Eddie. I know we can.

We shouldn't donate money as you know everyone will take their cuts so that the truly needy will get a greatly diluted contribution. As professionals Doctor, we can both give something much more than money ........................ our services. How's this for a proposal, you go to Africa and provide free medical services to the citizens of Darfur for two years and I'll do their wills free of charge.

Careful what you wish for. Bush's friend Putman is trying to do that. I don't think we have big enough army to force elections in Russia to. At least fair ones.
