Probe Sought in Terri Schiavo 911 Call
Florida Governor Questions Husband's Response to Collapse
By JACKIE HALLIFAX, AP

TALLAHASSEE, Fla. (June 17) -- Gov. Jeb Bush said Friday that a prosecutor has agreed to investigate why Terri Schiavo collapsed 15 years ago, citing an alleged time gap between when her husband found her and when he called 911.

Bush said his request for the probe was not meant to suggest wrongdoing by Michael Schiavo.

''It's a significant question that during this ordeal was never brought up,'' Bush told reporters.

Michael Schiavo's attorney has said his client called for help right away.

In a letter faxed to Pinellas-Pasco County State Attorney Bernie McCabe, the governor said Michael Schiavo testified in a 1992 medical malpractice trial that he found his wife collapsed at 5 a.m. on Feb. 25, 1990, and he said in a 2003 television interview that he found her about 4:30 a.m. He called 911 at 5:40 a.m.

''Between 40 and 70 minutes elapsed before the call was made, and I am aware of no explanation for the delay,'' Bush wrote. ''In light of this new information, I urge you to take a fresh look at this case without any preconceptions as to the outcome.''

McCabe was out of state Friday and couldn't immediately be reached for comment, but Bush said McCabe has agreed to his request.

Michael Schiavo's attorney, George Felos, did not immediately return a telephone call seeking comment from The Associated Press. But on Wednesday he said his client didn't wait to call for help and has conceded that he confuses dates and times.

Felos has said that if Michael Schiavo had not called 911 immediately, as Bush and others allege, Terri Schiavo would have died that day.

''There is no hour gap or other gap to the point Michael heard Terri fall and called 911,'' Felos said. ''We've seen the baseless allegations in this case fall by the wayside one by one ... That's what I would call it, a baseless claim to perpetuate a controversy that in fact doesn't exist.''

Terri Schiavo died March 31 from dehydration after her feeding tube was disconnected at her husband's request, despite years of efforts by her parents, Bush and others to keep her alive.

The governor's request followed the release Wednesday of an autopsy concluding that Terri Schiavo had been in a persistent vegetative state and revealed no evidence that she was strangled or otherwise abused before she collapsed.

It left unanswered the question of why Terri Schiavo's heart stopped, cutting oxygen off from her brain. The autopsy showed she suffered irreversible brain damage and her brain had shrunk to half the normal size for her age.

Bobby Schindler, Schiavo's brother, said Friday his family believes more questions were raised than answered by the autopsy report and that a new legal review is appropriate.

''Anything that can shed some light on the cause of Terri's collapse is going to be welcomed by our family,'' he said from Bloomington, Minn., where the family is speaking at an anti-abortion convention.

But the request was immediately criticized by some lawmakers.

''Enough is enough,'' said Democratic Sen. Ron Klein. ''I don't want to see it on TV any more, I don't want to hear politicians talk about it. Let her be at peace.''

Bush acknowledged in his letter that an investigation may be difficult.

''I understand that these events took place many years ago, and that you may not be able to collect all the relevant records and physical evidence. However, Mrs. Schiavo's family deserves to know anything that can be done to determine the cause and circumstances of her collapse 15 years ago,'' Bush wrote. ''The unanswered questions may be unanswerable, but the attempt should be made.''

i really think schiavo was a bastard...and i think his motives were shitty...

but,i also have to say that i`m not entitely sure that terry isn`t better off now than before....

a sad statement...

no common sense in this country...if the decision was made for the woman to die...and any way you spin it,that`s what happened,we should have the common decency to give her a fast, humane death....like we afford condemned murderers....

think about it....we`ll put a sick dog to sleep...but we`ll dehydrate a human being to death over a period of weeks...

not to mention the suffering of the family..

i guess that means i`m for euthanasia...if the determination has been made that someone`s going to die regardless... i am for it...

i`ll take the needle anyday...in a coma...awake...i don`t care..

and a large part of not being able to do that lays at the feet of the far right....

if anyone still gives a rat's ass about the schiavo debacle, then they got problems. it was never our business to begin with. what the hell, let's throw more public money at it and continue to disgrace this woman long after death. If the roles were reversed, we'd be hearing countless whining about how "the liberals just won't accept defeat and let it go"

indeed - "let it go".

"let it go"......."it`s none of our business"...

of course it`s our business...how someone dies in this country is our business...

whether people have the right to decide if someone lives or dies is our business..

can`t think of many things are more "our business"...

it came down to court rulings...and the make-up of the courts...their "judicial philosophy" is one of the larger issues in this country as we speak....

just because it doesn`t affect "your little existence" doesn`t mean it isn`t pertinent in the larger scheme of this society...

c`mon...

But we started forming opions and assumptions about people we didn't know. It made no sense. Fundamentalists auyomatically attacked the husband and trusted the word of the family, without actually knowing anybody.

It was pathetic and to drag it out still today is beyond sad.

you would be best to get an educated opinion on this from someone in the medical community. Someone you know outside of this topic. This whole case would have started a major sheit storm as far as guardians of those in her condition. I could go into it, but to hear the ramafications from someone in the know, would do you much better.

Also, how someone dies in this country is not our business.

i.o....all due respect...i`ve read a ton of stuff on this case....and i`ll tell you that the cronyism and political crap that went on behind the scenes would make your hair stand on end...

it was more about politics and money than terry schiavo...

from the conflict of interest that involved the judges and atorneys involved in this case....to the changing of the law in 1997 as to what constituted"artificial life sustaining measures"..........

these judicial and political hacks literally had to change laws to pull terry schiavo`s feeding tube....

that`s scary..

this is what i wrote before on this issue...this was a slam dunk from the jump...it was fixed in michael schiavo`s favor....

politically and for financial gain.....

""" the changing the"artifical life support" law in florida in 1997 ...when mr schiavo started pushing to have the tube withdrawn.... florida did not consider a feeding tube artificial life support...

after the schindlers discussed their potential case at length with then "atty shames" and wanted to hire him to represent them to remove the guardianship of their daughter from michael schiavo(turned out they couldn`t afford him), shames announced his candidacy for sixth circuit court judge......upon being elected, shames was assigned the guardianship case of schindler v. schiavo..... and shames failed to disqualify himself as required by law....as the schindlers had consulted with him on the case when he was an attorney..........

.

"""The Florida Code of Judicial Conduct dictates that a judge is mandated to disqualify himself in a proceeding in which he has personal knowledge of disputed evidentiary facts concerning the proceeding and if the judge has served as a lawyer (""or been consulted"") in the matter in controversy."""....which he was by the schindlers"...

then with jurisdiction over the case,he assigned george felos as michael schiavo`s attorney....the same felos that was chairman of the board of directors of suncoast of florida hospices...the same board that o.k.`ed the shuffling around of terri so that the tube could eventually be pulled...without the consent of the schindlers...

the schindlers challenged the 1997 removal of terry`s feeding tube...and won...because the feeding tube wasn`t considered an artificial measure to sustain life...

Rep. Gus Bilikaris was a member of that committee----and a member of the board of directors at Hospice of Florida Suncoast with Felos---and a campaign contributor to george w. greer and atty(now judge) shames.....

he and other campaign contributors helped sponsor a bill that passed in april 1999...(bill 2131)...signed by idiot jeb bush....... to change the definition of "life prolonging procedures" to add "including artificially provided sustenance and hydration which sustains, restores or supplants a spontaneous vital function.".....

now they can pull the tube....

and btw.....shames o.k.`ed a $500,000 atty fee bill for pelos.....out of the settlement earmarked for ms schiavo`s rehab.....lmao...

talk about conflict of interest..
"""""
Four months later, the Schiavo/Felos petition to remove the gastric feeding tube of Terri Schiavo went to trial without jury----to be solely decided by Judge Greer(love that...no impediments here)..... On Feb. 11, 2000, Greer signed the order authorizing Michael Schiavo to remove Terri’s assisted feeding, ruling that Michael Schiavo’s self-serving hearsay testimony, prohibited under law, constituted ...""clear and convincing evidence that Terri Schiavo would not want to live. """"...that`s laugh out loud funny...

tell that doesn`t stink to high heaven....

i.o...i know a little about this case...it was a political football....and the fix was in....

the liberal media wasn`t interested in pursuing it...it didn`t fit their agenda, with the randall terry`s and the religious right on terry schiavo`s real familiy`s side... a big mistake by the schindlers...

this background stuff just wasn`t reported by the mainstream media....

If it was murder in the 1st, he'd be on trial correct?

Guess it isn't until that's the truth.

So no need to carry on that was and take away from the basic issue.

I'm not talking about this case directly. I'm referring more to the issues it dealt with. I'm sure you're right on target concerning the real motives of all involved.

Let's not forget.........

both sides were manipulating on this one and not completely open about their motives.

This particular case is totally rotted to the core. Nothing good can come from trying to look into it any more.
