Sheriff Howard Smith said yesterday that a detective paid for and received oral sex during an investigation into suspected prostitution at the Moon Spa, a now shut-down massage business next to Old Country Buffet on State Route 3 in Spotsylvania.
Smith said that detectives went into the business, which was raided in late January, four different times. But he said only once did sexual activity, as defined under Virginia law, occur.
Smith said four women and a man are charged; police started investigating after noticing numerous men going into Moon Spa late at night. The man and woman suspected of operating the business face felony charges of receiving or conspiring to receive money from prostitution.
Three women are charged with residing in a bawdy place. One of those women, 51-year-old Kwi Ok Aguirre, is also charged with sodomy and prostitution in connection to the alleged sexual activity with police, Smith said.
Smith said the decision was made to allow the detective, who is single and who volunteered, to go through with the act so they could file the felony sodomy charge instead of just a misdemeanor prostitution offense.
Also, according to a joint prepared statement by Smith and Commonwealth's Attorney William Neely, the workers at the Moon Spa spoke little English, so a simple verbal agreement was difficult. To build the case, the statement says, it was necessary to "proceed farther than would normally be done in a simple street prostitution arrest."
