Actually my sister does, which means I do in a way.

She is being sued for 2200 bucks by a Credit Card Company...Aspire Visa. Of course this is all her fault as she never did pay off the credit card & failed to heed the warnings.

Does she have any course of action here other than paying the full 2200 up front? Which entails her borrowing the money from me to pay it off.... :mj16:

The letter from the court says she has 35 days to notify them or try & contact the plantiffs attorney...

Tell her to call them, explain some sort of financial hardship, most of the CC companies will cut you some kind of deal like 50-75%, they have already accounted for most if not all the loss and will be happy to get a check for some amount... Make them an offer....Hope this helps.

As a former employee, during undergrad, of a credit card company who bought bad debt then tried to collect by suit or issuing another bogus card with high fees and annual fees, this debt was probably bought for pennies on the doller, I agree to call the plaintiffs attorney and try to settle for less then 50% of the amount owed, if she does proceed to court, the court will award attorney fees, costs, and interest.

not an attorney, but I would definitely contact whomever and offer about 600 bucks to pay it off then negotiate from there. The cc company has to get a lawyer in whatever state she lives in to file suit (I think), and more often than not, it's a pain in the butt for them, so they're glad to get whatever they can.
