I don't. Lots of my cohorts in the outdoors world are ready to send them to the pen for years (I read elsewhere the charges had a max time of 50 years in jail). It wasn't right what they did, but jail time for cheating in some fishing tournaments?? :shrug:

BENTON, Ky. - A pair of fishing buddies were charged with 10 felonies after being accused of cheating in fishing tournaments on Kentucky Lake and Lake Barkley on the Kentucky-Tennessee border.


Marshall and Lyon county grand juries on Tuesday indicted Dwayne E. Nesmith, 43, of Island, and Brian K. Thomas, 31, of Dawson Springs on nine counts of theft by deception of over $300 in Marshall County, one count of complicity to commit theft by deception of over $300 and one count of attempted theft by deception of over $300 in Lyon County.

An investigation of the pair started April 30, when the men allegedly stashed five live bass in a fish basket in the water, then picked them up to weigh in at the Relay for Life Buddy Bass Tournament at the Lake Barkley State Resort Park, state police said.

Kentucky Department of Fish and Wildlife Resources Sgt. Bill Snow said someone reported the bass, which were marked with clippings in their fins.

Nesmith and Thomas were witnessed picking up the fish early on the morning of April 30, then putting their catch in the boat, Snow said.

Snow said the men allegedly entered three of the stashed fish in the tournament's weigh-in at the end of the day.

That sparked an investigation into tournaments the pair had previously won, Snow said.

Kentucky State Police Sgt. Brent White said Nesmith and Thomas won several thousand dollars and a bass boat worth $30,000 by allegedly catching fish before a tournament, then submitting the fish as being caught during the competition.

The two men were arrested Tuesday after the grand juries handed up the indictments.

Find a way for them to repay winnings, maybe take the boat, and ban them from competition. But jail is over the top.

It's illegal to be in possession of steriods, but the Olympic athletes who get busted don't get jail time, only a ban from their respective sport.

i would lock them up and throw away the key. the world needs less fishermen. if kentucky also has the electric chair i would consider that. lethal injection is too good for them.

As an avid fisherman and someone that competes at the pro level in tournaments I would say that jail time is a good option. What some of you may not realize is the expense and the effort that goes into preparing for a tournament. The winnings are nice but the total purse does not reflect the effort. Also the tournament in which they won the boat was a large one with lots of competitors and it is not just the money they won but also the money they prevented the others from winning. It is theft pure and simple and who exactly will be the one to say that some theft is ok? Please don't equate this with petty theft either as I am sure the one tournement in which they won the boat the take on that "caper" was well over $50,000.00. So let me ask you this; if someone stole $50,000.00 from a non-profit agency that helps kids and did it continually for a period of years, do you still think jail time would be ridiculous?

OMAHA, Nebraska (AP) -- A 71-year-old nun who co-wrote a popular marriage-preparation program was arrested on charges of improperly spending more than $300,000 on casinos, gifts and air travel.

Sister Barbara Markey, who was fired in January as director of the Omaha Archdiocese's family life office, turned herself in Wednesday and was released on her own recognizance.

According to the arrest warrant, an audit found that Markey spent $307,545 for her own use or without documentation. Some of the money was spent on cash advances, casinos, gifts and airfare, the audit said.

Defense attorney John Stevens Berry Sr. said the case stems from a disagreement about ownership and funding priorities related to the FOCCUS marriage preparation program, which Markey helped develop. The program is widely used in the Roman Catholic Church.

Markey was charged with theft by deception, a felony punishable by a maximum of 20 years in prison and a $25,000 fine.

It is kind of funny how the logic goes.

I know a lot of you are saying, "Gee guys.....it's a fishing tourny. Let it go."

But it's some serious jack, and that has to be the ultimate factor. They "stole" the winnings, for all intents and purposes.

If the boat was sitting on the dock, and the prize money was in it, and someone just drove off with it, I'm guessing you would say they should go to jail?

Hell no, not harsh enough! If you really want to punish these guys for their wrongdoings, prohibit them from watching NASCAR for a year or two. That will teach them!

I don't know; it still doesn't add up to me. The boat was the bulk of the winnings, and it can be returned to the sponsor or given to the second place team. Easily corrected.

I could be wrong, but it just doesn't seem the same to me. I also have a little bit of a bias AGAINST tournament fishermen, so that's not the reason I'm having a hard time with this. Nothing worse than going out to the lake to fish and the tournament guys come blazing through waking you to the bank.

That's where the problem lies.


Now, I can undertstand the argument that "these guys are not common criminals", and perhaps that has some merrit.

But, how do you know the guy who stole a car didn't do it just that one time?

To me....it's all about the where that person's mind is at, and these guys had to do some pre meditating to pull this off.

Personally, I don't know why anyone would feel sorry for someone like this.
