Students Break Teacher's Neck During iPod Scuffle

(CBS 3) PHILADELPHIA A popular Germantown High School teacher suffered a broken neck Friday during a scuffle with students over a prohibited electronic device.

The alleged incident happened just before noon after math teacher Frank Burd confiscated an iPod from a 11th grade member of his class.

Following class, authorities said the 17-year-old student and a 15-year-old freshman then assaulted the teacher in the hallway, knocking him to the ground.

"One student pushed the teacher, the teacher fell over, he suffered a gash on his face and broke two bones in his neck," said Paul Vallas, School District of Philadelphia CEO.

Authorities said the 60-year-old teacher was taken to Albert Einstein Medical Center where he was listed in stable condition. He suffered two broken vertebrae in his neck and cuts to his face.

"This is really a very heinous act and it was very deliberate, it wasn't accidental, it was a premeditated act," said Vallas.

Police said the students, who have been in trouble in the past, fled the scene. Both juveniles were arrested several hours later.

Vallas went on to say both students face serious criminal charges and will be expelled. Vallas also said the two students involved in the attack were in the process of being expelled from the school because of disciplinary reasons.

The attack was captured on tape via surveillance cameras in the hallway; however, police said they do not intend to release the video to the media.

The two teens have been charged with aggravated assault, simple assault, and reckless endangerment. So far, the two are being charged as juveniles but that could change depending upon a decision by the District Attorney.

Driving out of the city because our current leader feared him and he ended up not being the 'yes' man for the job. It's been said Vallas will be back to possibly run for Mayor.

Being a teacher myself I have 2 million worth of liability for just these situations. I fully expect one day to be confronted in a physical manner. I also fully expect that student to have his ass beaten. I have had students cuss, fuss, and threaten but it has never gotten physical. With the way public has gotten and my inability to allow a smartass teenager to punk me out I now the day will come when mommy sues me for punching her son in the mouth. I am not advocating violence in any way, but when you have seen the things I have and how teenagers in public school act it make your blood boil at times. The sad part is it will only get worse. It doesnt sound like this guy had a fighting chance, I hope when my time comes I will. :mad:

Shoot, my dad retired from teaching K-5th grades (special ed) because he didn't want to have to deal with violent 10 year olds, let alone middle school, let ALONE high school.

It's a sad state of affairs.

Mostly 10th graders, but there is no difference. I was a young punk not long ago myself, but I at least had enough sense to know where to draw the line. Kids today on the whole have no sense of accountability and it is not all their fault. Public education is set up to cater to the lower tier kids while the upper tier kids get pushed to the side. I know some may not face these issues out in rural america, but I am also sure many others know what I speak of. I love kids and want to help them succeed, but some are beyond anything we can do. I wont get started on special education but here is a good example from last year. Short version = Student moves to our school from another state(Kicked out of previous school) Gets written up 15 times in his first week. Shoves a teacher, slaps another in the back of the head, threatens to stab a teacher, and threatens me in the hall among many other things. I walked to the principle and told him that I wanted it documented that they could/would not do anything to this kid. The explanation given to me was he was off his meds, and they did not have all his paper work so they could do nothing to him. I fully expected this student to bring a gun/knife or something at some point and there was nothing they could do:shrug: I suggest everyone go sit in on their kids classes from time to time to get a reality check.

God bless you. I do feel for those teachers with the "regulars" bunch in the ninth or tenth grade. Your job is to make a difference in the life of a child (one child), but the other 29 in the classroom make it so not worth it on a day-to-day basis.

Oh geez! It's all about the paper work. Have you ever sat in an A.R.D.? What the hell is that? Most of the kids you sit in for are not even your students. :cursin:

Well, keep up the good work. I am sure you're one of the many dedicated teachers we have in our free educational system.
