need some help please.....

to make a long story short, i own a brand new condo that was built in about 1995, lived there for about 7 years and was having it rented out by this couple with two kids afterwards. i have never met the tenents, and instead went with a property mangement to handle everything. the tenents stayed for about 5 years and i recently gave the property mangement a proper notice that i would be moving back. the tenents were not happy about moving and actually wanted to buy the condo. anyways they move out on may 31. the property mangement called me on the
31st of may to tell me that they checked the condo and everything was ok and told me to come put up my keys and documents. so i did, then i went on tuesday, june 5th to check the condo myself. the place was flithy and dusty all over the house. it probably wasnt as bad as many thinks but knowing that it was a brand new condo, me and my family taking care of the condo while we were living there for the first 7 years, and it still look like brand new after 7 years (which is not very long). when i checked the condo, there was a big writing in the master bedroom that look like it was just erased instead of painted over, the bathtub were all stained, the blinds and windows were FLITHY with dark, black dust. i could understand for some rust and stuff, but they should have some courtesy to at least clean the windows and stuff like that.

thats little background, my main question is that i want to talk to the property management and have them pay for at least the painting and cleaning of the condo because they said that they already gave the deposit back to the tenents, all of it 100%,(i was fuking piss once i heard that) i have never heard of people getting 100% back of there deposit. they 100% back because they played for the vacuum cleaning out of there own pocket. so i want to get as much as i can from these clowns, the property management is suppose to look out for your property and thats what i have been paying these clowns to do for 5 years.

if the mangement says that they can't do anything about because they gave the deposit back, CAN I TAKE SOME LEGAL ACTION?

i'm not a lawyer so i can't tell you the legalities & i don't where the property is...because each city has different landlord/tenant laws. but i do own rentals & manage them myself in the phoenix area & i can tell you what i would do & have done with tenants.....

the first thing is to take pictures of any or all problems that you notice....& then find out the cost of the damages.

usually when tenants move into & leave a rental a form called a move-in/move-out form is completed. get your hands on that form.

then what i would do before i speak to the renting agent is to speak to an attorney that specializes in landlord/tenant law...keep a record of what he charges &for the consultation & what he would charge for pursuing the tenants & rental agent for damages (if you go to court the loser usually pays for attorney fees of the winner).. then depending on charges & what he says i would speak to the agent just to feel him out.then i would weigh everything & go from there.sometimes it's cheaper just to repair things yourself then to pursue legal remedies...

Painting and cleaning are probably considered as normal wear and tear. If these are the only problems you've found after renting the unit out for 5 years, you're lucky!

My father had a townhome he rented to the same tenants for 6 years. They were a young couple with 4 kids under 10 years. They were "on again and off again" about paying their rent (which was below market value and never increased) but he was understanding and put up with it. He even paid for the plumber when one of their rugrats put a diaper down the toilet! They moved out and asked my dad to keep the security deposit in lieu of the last month's rent. They told him they'd leave everything in good shape.

Well, when they vacated, there were holes in the walls, the handle was broken off the sliding glass door and the carpets were completely trashed with what appeared to be bleach spots throughout the house. The place was filthy and the $450 security deposit didn't come near covering the damages! There was no point suing them as the guy was self-employed and his wages couldn't be garnished. Basically a court judgement would only have been a piece of paper.

To make this long story short.... consider yourself fortunate that you only have to clean and paint!

Sounds like cosemetic stuff. Your probably going to clean and repaint anyway so bite the bullet this time. Consider this a lesson and you'll know different in the future.

you are lucky, it doesn't sound that bad but they shouldn't have gotten their whole deposit back like IO said. looks like property management didn't do their job but maybe you should have been a little more involved in the tenants leaving. lesson learned. but I definitely would have a chat with property management again. what % are you paying them anyway...

ripken 8, they were getting about 10% a month.

this is the first time experience for me, but remember it's brand new condo that was built in 1995 and thats not old at all for property, thing main thing is that i cant believe they got the 100% deposit back to the tenents, plus shorted me $500 on my last months check for "refurnishment", and i aint getting back the $500 till about 2 months.
also the painting in the master bedroom is what gets me too! i probably just was picking about finding all the little stuff because i was angry.
well, i hope i get some more input from u guys because i'll be going to the property mangement to "handle some business" in a couple hours.

i agree with u too ar182, the management didn't give a flying shit, what the hell am i paying them the 10% a month for? that's another thing that i am pissed about.

You keep saying this. Since when is a 1995 corvette a brand new car????

Saying "Brand new, built in 1995," in the year 2007 does not make much sense. Any property 12 years old is very very far from brand new.

i think the life expectency of a automobile and a condo is way different.
