If you look at the NBA rulebook then Kobe should have been ejected if you stick to the book:

Here is exactly how the NBA RULEBOOK READS:

1. A player, coach or trainer must be ejected for:
(1) A punching foul
(2) A fighting foul
(3) An elbow foul which makes contact above shoulder level
(4) An attempted punch which does not make contact

They never enforce the rule book in this league though and we all know it.
