After several tries, U.S. officials finally nab Roman Polanski in 1970s rape case [Updated]

Roman

Three decades after he fled the United States following his arrest for unlawful sex with a 13-year-old girl, Roman Polanski was taken into custody in Zurich this morning and faces extradition to Los Angeles.

Polanski, the famed film director whose career continued to flourish even after fleeing for Europe, was arrested as he arrived in the Swiss city to accept an award at the Zurich Film Festival.

The Los Angeles County district attorney?s office learned last week that Polanski had plans to travel to Zurich this weekend, said Sandi Gibbons, spokeswoman for the district attorney?s office.

Prosecutors sent a provisional arrest warrant to the U.S. Justice Department, which presented it to Swiss authorities. On at least two previous occasions, the district attorney?s office has received reports that Polanski had travel arrangements to countries with extradition treaties with the U.S. and prepared paperwork for his arrest, Gibbons said.
?But in the end, he apparently found out about it and didn?t go,? she said.

A source familiar with the investigation told The Times that the U.S. Marshals Service had come close to arresting Polanski half a dozen times or so over the past few decades -- though several of those opportunities presented themselves in the last two years.

"For one reason or another, it just didn't work out," said the source, who spoke on condition of anonymity because the case was ongoing. "There are so many variables."

The source said Polanski always was very careful about when and where he traveled. But as new questions arose in recent years about the fairness of his case, the source said Polanski appeared to become more at ease about travel.

Thomas Hession, head of the Marshals Service's Los Angeles office, would not comment on specifics of the case but said authorities moved quickly on each lead. "Any time information was developed, the L.A. County district attorney's office and the Marshals Service immediately acted on it."

Asked if prosecutors would ask that Polanski be sentenced to time behind bars if he were returned to the U.S., Gibbons said, ?We?ve always maintained this is a matter between Polanski and the court. ? We initially recommended prison time for him, but I can?t see into the future.?

An attorney for Polanski, Chad Hummel, declined to comment. ?Right now, we?re not in a position to say anything,? he said.

[Updated 1:00 p.m. : In a statement, three Los Angeles attorneys representing Polanski indicated the arrest came as a surprise. The lawyers have been representing him in an ongoing attempt to have the case against Polanski dismissed on the grounds of prosecutorial and judicial misconduct.

"We were unaware of any extradition being sought and separate counsel will be retained for those proceedings,? wrote attorneys Douglas Dalton, Chad Hummel and Bart Dalton. Their request to have the 1977 charges against Polanski dismissed is currently pending before the state Court of Appeal.

The organizers of the Zurich Film Festival expressed ?great consternation and shock? over Polanski?s arrest and said the program honoring his films would go on in his absence.

A spokeswoman for the event, Nikki Parker, wrote in an e-mail that neither Polanski nor the organizers considered his legal status in the U.S. an issue in attending the festival because he often traveled to Switzerland and even owned a home there.

?There was no concern whatsoever,? Parker wrote.]

Polanski, now 76 and a married father of two, asked the court to throw out the entire case based on new allegations of prosecutorial and judicial misconduct detailed in an HBO documentary last year. The L.A. district attorney?s office argued that he could not make such a request while a fugitive, and an L.A. judge earlier this year agreed. A 1997 attempt at settling the case also failed.

Polanski was arrested 31 years ago at a Beverly Hills hotel after a 13-year-old girl accused him of sexually assaulting her during a photo shoot at actor Jack Nicholson's house.

A 1978 arrest warrant, issued after he failed to appear at his sentencing on the statutory-rape conviction, is still in effect, and he would be taken into custody upon arrival on U.S. soil. The director of "Chinatown" and "Rosemary's Baby" has not returned to the U.S. since then but continues to work as a director, winning an Oscar for "The Pianist."

Polanski?s stay in Switzerland could be brief if he opts to return to Los Angeles.

?If he agrees with an extradition, he could be sent to the U.S. in the next days,? said Guido Ballmer, a spokesman for the Swiss Federal Department of Justice and Police.

But if Polanski declines to come back without a fight -- perhaps a more likely scenario given his three decades as a fugitive -- the court process could be quite lengthy, Ballmer told The Times.

The appeals process has several layers and could last months, if not longer.

IF the conviction STICKS, APPARENTLY? Wease...this guy is scum period. I think the young lady...errrrr KID forgave this POS, but apparently he felt the need to flee because he MUST of done SOMETHING with a 13 yr old. There is no consent when it comes to children, the sick whacko muthafucker from what I understand allowed her to consume champagne and quaaludes before "molesting" her. As u mentioned he had some of the best trim in Hollywood, but only a kid would send him into Jollywood. Jail time should be mandatory but Im sure he'll get some bs treatment IF he even makes it into a LA courtroom.:violin:

Good and interesting flick that doesn't really take sides too much.

Towards the bottom of the article it quotes Polanski as saying it was consensual. wine and drugs and sex with a 13 yr old. How is this not a problem if he admits it. parts of our society are F'ed up. what if it was their child. crazy stuff.

ZURICH/PARIS (Reuters) ? Film director Roman Polanski, arrested in Switzerland over a U.S. charge of having sex with a 13-year-old girl in 1977, will fight extradition to the United States, his lawyer said on Monday.

Polanski, 76, who has dual French and Polish citizenship, was detained on Saturday after arriving to receive a lifetime achievement award at the Zurich Film Festival.

"He is in fighting mood and determined to defend himself," Herve Temime, Polanski's lawyer, told France Info radio, adding his client was stunned by the arrest as he was a regular visitor to Switzerland, with a chalet at the ski resort of Gstaad.

"We have begun by requesting his release, which should be done today in principle," Temime said. "There is no reason in law, or regarding the facts or in terms of the most basic justice to keep Roman Polanski a single day in prison."

A Swiss justice ministry spokesman said it was theoretically possible that Polanski could be released on bail, although that was very unlikely. "The criteria for bail are very strict," spokesman Guido Balmer said.

Polanski was initially arrested in the United States in 1977 and charged with giving drugs and alcohol to a minor, Samantha Geimer, and having unlawful sex with her. Geimer of Hawaii has since said Polanski should not face any jail time.

French Foreign Minister Bernard Kouchner spoke to his Swiss counterpart Micheline Calmy-Rey to discuss the case, a Swiss ministry spokesman said. Kouchner also told French radio on Monday he was working with Poland on the matter and had written to U.S. Secretary of State Hillary Clinton.

During a visit to Paris on Monday, Swiss Economy Minister Doris Leuthard said the country had no choice but to enforce an international arrest warrant against Polanski.

"The Americans strongly believe that the arrest of Mr Polanski is necessary. That's for them to decide. Switzerland is simply a state where the police functions and where we treat all people in the same way," she told a news conference.

Leuthard rejected suggestions Berne had arrested Polanski to help patch up ties strained by a high-profile U.S. tax case against Swiss bank UBS, which agreed a settlement over charges it helped wealthy Americans stash assets in secret accounts.

"The two things have absolutely no connection," she said, and when pressed on the timing of the arrest referred further questions to the Swiss Justice Department.

Swiss authorities have said that in the past they only heard about Polanski's visits after he left the country.

FREE POLANSKI?

The U.S. authorities have up to 60 days to make a firm extradition request, but Polanski can appeal to the Swiss Federal Penal Court of Justice.

Wearing red badges reading "Free Polanski," the Zurich Film Festival jury accused Switzerland of "philistine collusion."

"We hope today this latest order will be dropped. It is based on a three-decade-old case that is all but dead but for minor technicalities. We stand by and wait for his release and his next masterwork," said jury president Debra Winger.

Other members of the movie profession including Italian actress Monica Bellucci, French actress Fanny Ardant, president of the Cannes film festival Gilles Jacob and Hong Kong director Wong Kar Wai issued a petition demanding his immediate release.

Public opinion is divided. Responses to a Reuters blog on the Polanski arrest included those who opposed it as a waste of U.S. taxpayer money and people who supported the move.

"In my opinion it is totally right to arrest Mr. Polanski," wrote Otto Meier. "What he has done is awful and needs to be atoned."

Polanski has avoided countries with extradition treaties with the United States since fleeing in 1978. He has never returned to Los Angeles, where his pregnant wife, actress Sharon Tate, was murdered by followers of Charles Manson in 1969.

The director was originally indicted on six charges, including rape. He has insisted the sex was consensual but pleaded guilty to a single count of having sex with a minor and received a sentence of time served after spending 42 days in prison undergoing psychiatric tests.

Polanski fled on the eve of his 1978 sentencing because he believed a judge might jail him for 50 years. His lawyers tried and failed earlier this year to have the case dismissed after a documentary raised new questions of judicial misconduct.

Los Angeles County District Attorney Steve Cooley said on Sunday Polanski had received a very lenient sentence, which would never be achievable under today's laws.

"Some form of justice will finally be done," he said.

Born to Polish-Jewish parents on August 18, 1933, Polanski spent his first three years in Paris before the family returned to Poland. He escaped when the Germans sealed off the Krakow Jewish ghetto but his mother later died at Auschwitz.

Polanski scored a huge hit in the United States with 1968 horror thriller "Rosemary's Baby," and another with 1974's "Chinatown," a stylish thriller starring Jack Nicholson that was nominated for 11 Academy Awards.

"Tess" (1979) also earned him an Oscar nomination, and Polanski finally won his only best director Oscar for the 2002 film "The Pianist," the story of a Jewish-Polish musician who sees his world collapse with the outbreak of World War Two.

Woody Allen and Martin Scorsese: Free Roman Polanski!

Today 1:20 PM PDT by Josh Grossberg

Martin Scorsese and Woody Allen want Roman Polanski back on the streets. Jewel, not so much...

The two Oscar winners, along with Pedro Almod?var, John Landis, Jonathan Demme, David Lynch and more than 100 filmmakers, actors and industry types, have signed a petition objecting to the fugitive director's arrest and demanding his release from a Swiss jail.

Authorities in Zurich took the 76-year-old Polanski into custody Saturday at the behest of Los Angeles prosecutors, who want him brought to justice for a 1978 statutory rape conviction.

The fact Polanski's been on the lam for drugging and then having sex with a 13-year-old girl didn't seem to faze his fellow filmmakers, who are peeved that the Academy Award winner behind Chinatown, Rosemary's Baby and The Pianist was picked up while he was on his way to accept a lifetime achievement award from the Zurich International Film Festival.

"It seems inadmissible to them that an international cultural event, paying homage to one of the greatest contemporary filmmakers, is used by the police to apprehend him," proclaims the petition, which has the support of France's Society of Dramatic Authors and Composers.

Other notable signatories include directors Wim Wenders, Terry Gilliam, Wong Kar-Wai, Darren Aronofsky, Alfonso Cuar?n and Alejandro Gonz?lez I??rritu, as well as actresses Monica Bellucci, Tilda Swinton and Asia Argento.

"The arrest of Roman Polanski in a neutral country, where he assumed he could travel without hindrance...opens the way for actions of which no one can know the effects," the group added in their appeal.

But not every celebrity is on the "Free Roman" bandwagon.

"Polanski-admitted raping a 13 yr old-whys every1 in the arts upset hes facing jail? cause hes a gifted director? what am i missing?" asked bewildered singer-songwriter Jewel via Twitter.

Also chiming in was The View's Sherri Shepherd.

"Whew...long day at The View...two shows today...hot debate over the Statutory Rapist Polanski. 45 year old man plies a 13yr old w/drugs & Liquor and anally & orally penetrates her w/o her consent is a RAPIST," she tweeted. "We hunt down 75 year old Nazis. We must protect our children."

The outcry comes as Polanski's lawyers filed a potentially more binding petition of their own?asking the Swiss Criminal Court to release him from custody and block his extradition to the United States.

His legal team wants Polanski to be allowed to post bail or be remanded to house arrest at the Swiss chalet he owns in Gstaad.

The filmmaker holds dual citizenship in Poland and France and has remained in Paris since fleeing California authorities three decades ago.
