i`m not surethis answers the question, but(and i`m not sure) , i think if the person was relatively poor, and the cost of the funeral exceeds the assets left, you can keep the assets from creditors..........
not exactly sure...it may be a state by state thing...
I am quite familiar with the IRS as I manage a few businesses for friends and I fill out personal income tax returns for many of them as well every year. I have figured out a lot of ways to get a little extra money back from the government
But I believe the answer to this is no - you cannot deduct funeral expenses from your personal tax return. I could be wrong, but that's what I think after reading IRS documents for days and hours and weeks :scared
The exception I believe would be that you can deduct funeral expenses from the deceased person's estate.
For income tax purposes, there are no deductions allowed from taxable income, and no credits allowed against income tax liabilities, with regard to an estate's payment of a decedent's funeral/burial expenses, or a survivor's payment of a dependent's or non-dependent's funeral/burial expenses.
