Funny DUI acquittal

I am taking a criminal law class and I have a lawyer as a teacher. We were going over the chapter of jurisdiction and he brought this case up.

A man was sleeping in his car down by some lake that borders the AL/GA line. The whole lake is on the GA side. So he gets arrested for DUI and my teacher defends him. The water level is way down and as soon as jeopardy attached... he asked for acquittal because they didnt have jurisdiction. he stated that since the water is way down, he could have been on the GA side while he got the DUI. So therefore this city didn't have jurisdiction.

Pretty damn funny.....

No DUI aquittal is "funny" if the driver was indeed drunk.

well... i believe the reason the judge aquitted the case was because the man was at some party or cookout they were having.

He decided not to drive and to sleep it off in his car. \

and I agree...

Good story, nonetheless, Justin. Its refreshing to see that a criminal law class is being taught by a defense attorney.

And the moral of the story (for those who have partied a little too much to safely drive), "Call a taxi." Don't try to sleep it off in your vehicle.

yeah... most people think that if the car is not moving or running you cannot be charged for a DUI....

the only stipulation is if you are on private property and they cannot prove you were driving before you got on private property
