Gamblers Try to Hold Casinos Responsible for Feeding Their Addiction

David Williams' gambling addiction cost him his life savings ? almost all of it dumped into the slot machines at Casino Aztar (search) in Indiana.

Williams decided to take action. He sued the casino.

"Casinos cannot come into this state and just take advantage of a bunch of sick people," said his attorney, Terry Noffsinger.

The first judge to hear the case sided with the casino, but Williams has appealed the decision. His claim is among a growing number of lawsuits that aim to hold the gaming industry responsible for exploiting compulsive gamblers.

The Rev. Tom Grey of the National Coalition Against Gambling Expansion (search) said slot machines are "delivery systems" for gambling addiction.

"The more available and accessible we make it, the more addiction it delivers," said Grey, who predicts the eventual success of lawsuits that target casinos.

The industry says it tries to spot compulsive gamblers. It has "been very proactive to help out that 1 percent who can't help themselves," said Frank Fahrenkopf of the American Association of Gambling (search).

But that didn't happen in Williams' case. When his gambling got out of control and a worried friend asked the casino to intervene, Williams was banned from entering Aztar. But early in 1999, after 11 gambling-free months, the casino began luring him back ? mailing him tickets for complimentary hotel stays and meals.

Williams returned to the casino.

"It starts out as an adrenaline rush," he said. "But in a period of about seven days, I lost $38,000."

When it was all over, he had squandered about $175,000 and had to file for bankruptcy.

Williams' lawsuit claims the casino should have done more to keep him out. The casino counters that Williams was the cause of his own problems.

"You shouldn't sue McDonald's claiming they're responsible for your obesity problems," said Patrick Shoulders, Casino Aztar's lawyer. "Fundamentally, problem gamblers have to take responsibility for their own actions."

The U.S. District judge in that case agreed, ruling that under state and federal law, Aztar had no duty to protect Williams from his gambling habit. His attorneys have appealed the decision.

The Indiana Coalition Against Legalized Gambling has been monitoring the case and hopes it will be the first step in requiring more responsibility from casinos.

Meanwhile, the Indiana House of Representatives passed a bill that would authorize a statewide list of self-proclaimed compulsive gamblers who want to be barred from casinos. If they do try to enter a casino, they would be charged with trespassing. Casinos would be prohibited from sending them coupons or cashing their checks.

The bill is now before the state Senate.

Maybe they can state in the Bill they passed that the way to identify them could be a large tatoo on their forehead.... "LOSER". I don't mean to make fun of the fact that certain people are unable to control their gambling, but this is a joke! One more way for lawyers to help make complete idiots of individuals who can't take control of their lives.

I'm not going to get baited into this one, AR. However, in my opinion, casinos are somewhat culpable. Probably not legally, and maybe rightfully so, but they do know who the compulsive gamblers are and I believe continue to encourage them to gamble.

In Indiana, and I think Illinois, you can banish yourself from the casinos. Whats real interesting about self banishment, is if you play after banishment, and you win, and they find out, you forfeit the winnings. What if you did that then hit a Carribean Stud poker jackpot. Ouch.

Casinos are certainly responsible, let's face it they encourage you to bring every dollar you own, every dollar you can borrow, all your credit cards etc.. and stay and play all night long, but you should know that going in shouldn't you? At what point do people, even the weak minded, become responsible for their own actions?

I'm not sure if I would characterize individuals who are -compulsive gamblers as "weak-minded". I'm pretty sure its a disease recognized by mental health professionals in the DSM.

I try to take the same approach with any addiction whether its drugs, alcohol, sex :) gambling, food, etc. I still struggle with the issues of personal responsibility vs. inability to control.

I mean I know a lot of people who live by the "...pull yourself up by your bootstraps..." approach. Just not sure everyone can do that.

It seems easier to understand when you look at compulsive behaviours surrounding alcohol and drugs. Gambling, food, sex are harder to understand.

I'm quite certain science has shown chemical imbalances in the brain in those who have obsessive/compulsive disorders. I know many think this is hogwash.

Tough call for me. I just don't know if compulsive gamblers can really help themselves without treatment. Same thing with those suffering from alcoholism.

Hey as far as casinos making it easy to get bucks for those not afflicted, thats fine with me. Hell, if you dont know that you have little or no chance (and little just left town) when you walk into a casino, then your one dumb puppy.

yeah the mental health professionals who also claim that asthma is a pyschological manifestation of being separated from your mother and inflammatory bowel disease as punishment for not being able to receive the "gifting" of diarrhea....

the DSM is a big joke written by a bunch of perverts/pseudo-intellectuals who are way out of touch with the real world

i've never been much of a plaintiff's attorney, spending much of my career in criminal defense. i've never really cared much for the lawsuits by individual over being victimized for their addictions (smoking, gambling, overeating). i make an exception for the smokers who acquired smoking-related illness before the time that tobacco's carcinogenic properties were known. the tobacco companies combining to simultaneously suppress research about tobacco's properties, advertise that in fact it was not harmful, and injecting additional nicotine to increase its addiction i find especially repulsive.

Lets face it Guys. Just about anything that is addictive it's made to look good. You see any boring adds about Vegas. Beer and Cig adds are all about being cool. Cig adds are not on TV anymore. but where you see them they are not going to tell you they can help kill you.

eddie, i didn't post this to bait you, not my style.i posted this to open a discussion with my madjack friends. i just think it is wrong for people to blame others for their problems. people have to take responsibility for their actions.

i agree with you about the smoking situation. tobacco companies intentionally added ingredients to make the smoker more dependent on smoking.

Does this mean that I , a raging recovering alcoholic, can sue Jack Daniels for me being an alky and drinking too much of their booze? Does thier advertising and and publicizing their product make them responsible for those who drink the booze?

You are the only one to blame for the things that you do! end of story! If I am a compulsive gambler I need to get help for my problem and if I am a compulsive overeater then I need to get help for my problem! I don't need to cry and whine about it to some lawyer that it was not my fault! I am an alcoholic of my own accord and not because somebody put the shit in my face, Nobody is responsible for anyone but themselves and their own actions!

I don't think casinos should be held accountable for the poor assholes that can't control their own actions. Let me guess, they want to sue for all their lost money? Let me ask you this - If that same person with the gambling problem hit the really big jackpot, would they still have a "gambling problem"? Would they still admit they have a problem and give the casino back all their winnings? :nono: Then why should the casino give back all of their winnings? The casino didn't get in their car and drive them there. The casino didn't make them get out of their car and walk in either. This ranks right up there with the fat phuks suing the fast-food industry.

The only thing I disagree with in casinos is the lack of clocks and windows. They even strategicly place the restrooms. Notice that there aren't any restrooms inside your favorite casino buffet or restaurant. You are forced to leave the restaurant and pass by slot machines on your way. What about all these HSN type TV channels that prey on the elderly and take advantage of them? I'm sure you've heard of the little old ladys going broke because they are victimized and end up buying too much? You can't even scroll through your channels without stumbling across them. Does that mean we should sue them too? After all, "I was just trying to innocently scan through the channels, and then I was trapped into buying all their crap!"

Everthing has a price. Everything has a worm on it to catch whom or what ever posiable. It's like those lieing services that everyone talks about here. You stick with them. No ones fault but your own.
I do agree some products are made to look so good it easy for someome to bite. There is always someone bateing someone else. This did not start yesterday. I guess maybe 2000 years ago at least. Some of the liars should be held accountable if it can be showen they did indeed lie.

It's the same with everything. I've DJ'd in Titty Bars for years and everyone of those girls drains every dime a guy comes in there with when given the opportunity. When that's gone the manager will be happy to escort him to the cash machine where he pays the club an additional 10 to 20% on top of the credit card fees to get more out to blow on some bimbo that will tell him he is the coolest guy that she has ever hung out with until his money is gone..........This country has made it way too easy for people not to have any accountablity for their own actions, and it's only getting worse.

leonarde tose, who owned the eagles, sued a casino in atlantic city claiming that the casino got him drunk intentionally, causing him to lose $million's which eventually caused him to sell the eagles. he lost the case & died broke a few months ago. i think this guy will lose also for the same reason, we are responsible for our own actions.
