Divorce Question

Not to get real personal. I have been married a little over a year. My wife has uncovered some of my bad habits, especially "Gambling" I didn't know that gambling was a bad habit. I may have to choose between marriage or gambling and I'm leaning towards gambling.

My question is this: I have a Condo with a 20 year mortgage that I've owned prior to getting married. It still just has my name on it. If I get Divorced do I have to split my Condo 50/50. If not case closed however if I do what happens next? Do I have to sell the condo and give her half of the proceeds?

i'm pretty sure most if not all states make you spilt what you have accumulated together. you owned the condo before you were married so you won't have to spilt that. i'm damned near positive and i'm not a lawyer.

you split what you accumulate together.

example; suppose you had 1 million dollars of assets before you were married and now you want divorce one year later. she has no right to the things you had before you got married, only the things you got together.

...close, but there are still circumstances that might not pan out this way. e.g. if you co-mingled assets...

It is very kind of you to offer to answer my questions. I'm not in too deep just yet however if it does look like I'm heading to a divorce I may just take you up on your offer.

...if in fact you owed the condo outright (no debt remaining on said condo) before you were married and you did not spend any marital money on said condo, it MIGHT be considered separate, not marital, property. There are no concrete answers in these types of situations.... Each case can be slightly different depending on the specific facts....

Many people live by the logic that you can always find someone who is willing to put up with your favorite hobby (gambling, drinking, pro wrestling, etc.), but it's much harder to find a new hobby that you love. Sounds cold, but it's true. Not saying I live by it, but I believe it. Hope things work out for you, Mr. Lock.

Seriously, it's more than just gambling that my wife doesn't like. Obviously, there is a lot of give and take in a marriage. I will try my best to work it out however if it doesn't work out at least I'll know where I stand( Financially that is).

depending on your state you probably have to split any appreciation that has happened since you were married. a more important question is are their children involved. when i first met with my divorce lawyer 3 yrs ago i asked him what he would do if his wife wanted a divorce. he said he would give her and the 3 kids the home and 60 percent of his income until they were all 18. i realize now after spendind 15k plus on fees and looking at alot more that he was right. bottom line is try and work things out and if unsuccessful try and negotiate either on your own or with an arbitrator. last resort is to get 2 lawyers on the payroll and fight over alot of meaningless stuff. you should not have much problem with condo. get my email from jack if i can help further. trust me i know divorce.
