brother's ex-girlfriend is driving around in his mercedes....car is totally in his name but she refuses to give it back.......he doesn't have keys or we'd go take it back.....and the police say it is out of their hands because it is a civil issue. Is his only avenue civil court here....or can he get a repo man to get the car even though we don't have any keys? Is there any way you can get a new key from the dealer if you bring in the title? Any and all help would be appreciated....this is one whacked out beeatch!!


I know there are a lot of intelligent MJ's out there in a ton of different fields....if you can help me at all here, much thanks in advance. :clap:

i'd say that's total BS on the cops part to say it is a civil issue. once she has been told she doesn't have permission to be driving it, it should be a STOLEN CAR......PERIOD!!!! They won't take a stolen car report?

yea, don't tell the cops it's a GF, just say it's stolen.

or get a repo man. and yes, the dealer can get keys for it.

report it stolen. cops have nothing else to do. say car was in driveway with keys in it and some girl took off with it, but you know where its at. they should take care of it.

thanks for the advice.....although I don't think he can report it stolen given the fact the cops know he and this girl were an item and she was given the car to drive......don't want to cause ourselves any problems here (false reporting).....just trying to get this car back with as little complications as possible. Gonna try the dealer tomorrow and see about a new key. Thanks again!!

you don't have to report it stolen, but what she is doing is criminal....file a police report for embezzlement..in addition he can sue for conversion...if he threatens her with these she'll give it back...he has a winner if it goes to court

In Cullyfawnia, it's a stolen car. If you don't report it as such, you are 100% responsible for any and everything tha happens

thanks terps and danmurphy.....he's going to stop at the police station tomorrow as well and try to get some details on what is what in Indiana and whether that cop in the field that told us he couldn't do anything knew what he was talking about.

If he has the title just have a towing company grab it and bring it back to him. Also I can't believe the police gave him that bs answer. They aren't married and its his car. All he should have to say is she no longer has permission to drive it end of story. Like DanM said what happens if she wigs out and goes on a hit and run spree.

good idea to go to the cop shop for additional facts MC ..... you don't need to provide any type of a false report. just make sure she has been told (and a witness is helpful) that she is NOT to be driving or in possession of that car, and the minute she drives it after that it is STOLEN, and can be reported as such. face it, if she won't give him the car back, it's hard telling what else she'd use it for that could end your brother up in a deep pile of chit!!

do you ever go to the dunes? if so, can you give me a clue as to whether or not the water temp is decent this year cuz of all the hot weather? as of right now, plan is to take the kids from valpo to the dunes for a few hours on saturday, and then to great america on monday.... just hoping the weather agrees with us.

Thanks mama......and yes, I live about 10 miles from the Dunes.....ever been to Mt. Baldy in Michigan City? Kids love trying to climb the face of that beast of a sand dune....they would really enjoy that. As far as the water temperature....they give the water temp. every night on the news during weather...the weatherman said the water temp. was 79 degrees!! :scared one of the warmest temps we've seen around here in awhile.....with all of the hot weather and no rain (we are 7 inches behind) the lake temp. has gone crazy. Could mean a bad year for lake effect snow around here as well!! :cursin: Hope that helps....if you have any other ?'s, let me know, I'd be more than happy to try and help.

79 degrees ------SWEEEEEEETTTT!!!!!! , figured the hot summer might be helping it out. we're majorly short on rain this year too. about 11 inches down from normal, and only 1.2 inches since the first of June... been great for lawn mowing tho ;) (the last time it was cut was fathers day weekend....LOL) i'd love to hear more about the climbing thing you're talking about. is it anything like climing the rock walls? my daughter just LOVES those, and it would be worth the short extra drive if that's what it is. Thanks :)

Keys for a MBZ are a little harder to come by. A dealer may be able to help you if you supply the VIN number. A key to mine cost almost $80 and there are not alot of locksmiths that have access to the blanks. Laser keys are tough!

Mt. Baldy is actually a natural sand dune that is 123 feet tall and it actually moves forward 4-5 feet per year buring everything in its path......trees....roads have been moved....etc. It is a big effort to climb up its face and kids love to run down it (but be careful doing this, if you get going too fast and out of control you can take a pretty nasty spill.) What's cool about it though, once you reach the top, it is just a gentle slop down to the water..a lot of beach. There are also a ton of hiking trails and other dunes to hike all along this stretch of lake.

Wow,does that bring back memories. We use to drive over to the dunes when we were teanagers. Had some great times there. :weed:
