I had an issue with the cable guy drilling through my drainage pipe from the upstairs shower...plumber came over had to cut many holes in wall nd through the backs of my cabinets....

The cable company sent out several escalation managers and said I should get new cabinets, the referred me over to their insurance company as the damage amount was too much. I had two different quotes provided from two seperate contractors a high and low one $9,000 and $15,000 respectively.

The Federated Insurance guy comes out, sends me a quote a few days later for $800. I blow my stack, cxall the cable company that this is unacceptable and that I will see them in court. IN hte mean time I spent 3 weeks in Dallas on business, the cable company calls back the insurance guy and wanted him to bring out a restoration contractor, and get his advice. (This happened while I was in Dallas) so only my wife was here. Basically his own contractor he brought said the ideas that he had (Federated INsurance guy) would not be able to be done. So he said he would quote it out, again based on the quote from the Federated supplied contractor.

Well that got us to around $2500-$3000. We also mentioned that we still can't believe that two contractors came out and mentioned that what this restoration guy was going to do was still very risky and not probable. I got their contractor to admit that to me as well. He then mentioned we should at least get another quote based on the countertops breaking during this restoration "process", the quote came back as $2000 more from a Home Depot guy that looked at it, (Who also verified that what they are trying ot do was wrong) so then this weasel of an insurance agent. We will call him "Prick" from now on...calls my wife today and says, accept the offer without the countertop bid within 5 days or they will settle for only $100, then close the case. He mentioned he took the case to his supervisor and that was his supervisor's response.

So what is next, I am pissed and will not settle for $100, or even the $5000 combined total that he already nixed. It is principle now, any suggestions? ANy lawyers ever fought a case like this against and insurance comapny? Would we take the insurance company to court or the cable company if it came down to it?

Looking for quick and valid repsonses, considering their small time frame, and my lack of patience with this little prick!

Now from experience don't know what court it will fall in...

BUT Small Claims judges hate insurance companies!!! Think they are the scum of the earth...

Funny thing was the judge walks into the court and says I hope I don't have an insurance company starting off the day. guess what it was had an insurance company sue me and I won, very funny story but I won in the end. Walked outta the court with my head held high and told the guys see u on the golf course, LOL!!! They knew they lost even though judge didn't give verdict for 2 weeks in the mail!! VERY FUNNY DEALL FOR ME!!!

TAKE THEM TO THE CLEANERS BRO!!!:D :D

Listen I would put money that the prick is bluffing. These guys
don't like to bring these problems to their Supervisors. Their
job is to settle and that is what he is trying to do. Its one of the first things they say to get you to be more realistic. I would have to think his Supervisor is unaware of your frustrations.

First instinct would be to call the pricks Supervisor. You could probably catch the Supervisor off guard as he may not even know about it. The prick could end up looking like well a prick.

But my suggestion would be to call their corporate headquarters and speak to a Regional Manager or someone in customer relations. You will have a much better chance of getting what you want at this level. This is your home. Most people are rightfully
upset when they their home is involved.

From reading the last post I remember thinking you should get
a satisfactory remedy. They are hassling you. I have a similar story about insurance company doing work and they paid me more than what I expected. After all the phone calls that is.

ANy suggestions or key terms I sould use when speaking with the RM... Lingo always helps ya know! LOL!!!

Much appreciation for the responses, really don't want to go to court, but am not afraid to! Time is the only issue concern with courtm and then that starts to piss me off again! The Prick!

You got to have a list and timeline in front of you so that you give the person all the details.

If they will not let you talk to Reg Mgr, talk to his Adm Assistant. Once they hear what your saying they will put you in touch with someone that should be willing to help get it handled.

Names, quotes , how you feel you have been wronged, express your frustration about the time you have spent and your house has been in a uproar over it. Give them the details and don't hold back. If you can do it calmly it works better. I never can. I just unload on them. But I also have all the information they need to help them understand the situation.

Then the chain of command starts to work.

They will have the pricks Supervisor on the phone.

Then the prick will be called in to discuss why his boss is calling him about dogface.

If the guy really was rude to you I would tell the person I talked to not to send the prick back and ask them for another person be assigned your case. If he was rude and unprofessional that is a reasonable request.

You still may end up in court but you will find out quicker what their position is by going this route.

agree with countinguy on small claims opinions of insurance companies, but these amounts are well over the statuatory maximums for small claims (3k-5k in most states), so I would say it's going to take a lawyer filing a lawsuit then a jury type "trial" to settle the dispute, and in that case, juries are made of laypeople who also aren't too fond of these tactics. GL, dogface, I think I would definitely get a lawyer and pursue this.

find out what the statutory limit is for small claims in your state..

in the long run..it may be just as lucrative to file in small claims for the max..instead of paying for a lawyer...

however, you may have some civil claims that apply triple damages or other punitive types of claims..such as consumer protection types of laws...in such a scenario the damages could far exceed the small claims court max therefore a lawyer would be needed...

if you do end up going your own route..name everyone you can think of in the complaint and let them fight over the amount due...after you win...its better to be safe than sorry...

of course the court process is going to take while ..thus most likely you will have pocket expenses the be reimbursed..

you obviously are not a pushover ..so tell that insur. guy...to go screw himself with that offer....

try to put as much communication in writingf as possible...this sets up a paper trail..once you get to court

Just using the "attorney" word usually breaks em down. As in, "you will be hearing from my attorney".

Looks like a lot of good advice here already to me.

Also for good measure say you will be filing a complaint with the Attorney General of your state...and DO it.


I don't think Prick will be closing this case until Dogface says its closed. Keep us up-to-date.

There is also a Office of Consumer Affairs in each states governors offfice. These people don't play when it
comes to consumer affairs.

I have used the attorney component to know affect earlier and consistently throughout the discussions. I placed a call into the Manager of LIability claims in MN, and have yet to not get an aswering machine of reply back.

I will definitely keep everyone posted, and if anyone out there has more adivce, keep the info coming. I like to have a lot of ammo, pick and choose, and when all else fails through it all at the "Prick"!

Remember guys, Federated INsurance is the company, and this "Prick" in MN is pissing me off!

Does your local TV News have a consumer reporter. I always see cases on TV when these reporters contact the companys, they cave in fast, because they don't want the bad publicity...

You said you used the attorney thing. You may try again this way if you have not done so. Send letter with nice words on attorney letter head. Cost should be low and affect high.
