I don't know that he was but when we go to the races some people will sit there with their phones and video every hot lap, heat race, and feature just to have it on video. Most of the times when a caution comes out and there is a wreck people whip out there phones in hopes that a fight will ensue, etc. There have been many nights where cars pull into the pits and drivers jump out and fists start flying and it seems like tons of people catch it on video. I think with the age of technology everyone tries to get as much as they can.

Thanks for the info. I realize ton of people are likely filming but it just seemed like he was really focused on Ward going into that turn. Though I also realize the bit of video may have been spliced from footage that guy was taping the whole race like you said and he just posted the pertinent part where he caught all the action.

Anybody who follows racing even a little knows that from the Beech Bend circle track here in BG to the Indy 500, race car drivers talk shit, get mad, retaliate, and often fight. They fight all the time, and many are incredible hotheads. Tony Stewart, in this group of racing hotheads, is a top-tier hothead. He's also an incredible dickhead, and I have personal knowledge of him telling a local mentally disabled 25 year old, "Leave kid; I don't have time for you!" All that said, he's not a sociopath, and he didn't kill this other driver on purpose. He would have killed somebody long ago if he was.

I can't stand the guy as a driver or person, but it's not his fault the other driver is dead.

So just to throw my 2 cents.

Civil Case

I have heard a lot about how Tony is going to lose his shirt. I disagree.

If a defendant can show negligence for the prosecuting party at a 50% capacity then it's equal fault. If 60% tony and 40% Ward, then 10% civil payout.

Given that Ward got out of his car, walked up to race cars in a moment of suspected (wasn't there) anger, in a black driving suit, on a dirt track at night...

If Stewart pays a dime I would be surprised.

If I was the lawyer, personally I would have my team perform due diligence on the owner of the tracks insurance policy. Lack of lighting? Negligence. Last safety inspection of code for racetrack? Negligence. Insurance money. Tony... not so much.

I think they would be wasting their time. Ward intentionally and aggressively walked onto the track seeking out Stewart. he knew the dangers when he got out of his car.

i agree,bud...but you always have a shot with a jury...we`ve seen insane verdicts handed down before....

personally,unless the video(I haven`t watched it) shows some obvious intent on stewart`s part,you`d think that most clear thinking people wouldn`t be able to find stewart guilty of anything given the young fellow`s own obvious negligence....

but,as we`ve seen before,people get revved up,take sides and become entrenched in their positions based on not much more than supposition...jury nullification is always a possibility

You don't think the insurance for the track will take the same approach of pointing out Ward's negligence in the situation?

On the flip side... here is an interview with Stewart Freisen. BTW this guy is engaged to marry Jessica Zemken. A racer chic that Tony used to fuck on a regular basis.
