In the fall of "05, my old Subaru SW was rear ended.
Other person at fault. Not an issue.
We were both insured by the same insurance company - State Farm.
Damage to the rear hatch, broken tail light and dent in body / frame near right rear tail light area.
Damage did not affect performance of the vehicle and I was still able to open, close and lock hatch despite the damage.
Claims adjustor arrives and looks at my vehicle.
He asks, "do you still want to drive this vehicle?"
I said "yes".
He wrote me a check for $1400.
I was satisfied.
Fast forward to last week.
Closed the hatch, but was unable to open.
Had to demolish the interior back panel in order to open the hatch.
Damaged lock assembly required replacing entire hatch.
Found a hatch.
Removed old and replaced with used.
Used hatch does not fit and will not lock due to original damage to the rear end.
(Damaged hatch + damaged frame still fit like "hand in glove". New hatch + damaged frame do not work together.)
Hatch will not close and I can smell exhaust fume in the passenger compartment.
After all these months have gone by, do I have any recourse here with my insurance company?
