He had only one item to sell.... He ran up the price with a buddy of his and then when the auction is over, his buddy can't pay. So, then he sends out multiple 2nd chance offers. While this would be fine if he had multiple items to sell and could meet all requests....(well, still not right to run up the bid) In this case, he only had one item to sell. When multiple people take him up on his second chance offer, he had created multiple contracts, but he only has the ability to fulfill one of them. He did refund my money after I sent a nasty e-mail, but my point is that he should not be allowed to send out multiple second chance offers if he only has one item to sell.
In legal terms.... He made an offer when he sent the 2nd chance offer. I accepted his offer when I sent him the money. He breached the contract when he refused to send me the merchandise we bargained for.
Other than the bullshit negative feedback left by this third grader which eBay refuses to remove, I wasn't hurt other than I had a good deal and legally speaking, I could go out and purchase the same merchandise and he would be liable for any additional expenses I incurred in procuring the same items that we had bargained for....
eBay sucks! ...but Arnie swallows! :scared
