Back from Afghanistan, Marine shoots would-be carjacker

MONTGOMERY, Ala.(AP) - A Marine sergeant based in North Carolina who served in Afghanistan earlier this year shot and killed a would-be carjacker.
Sgt. James C. Lowery, 22, returned fire after being shot in the face in the drive-thru lane of a fast-food restaurant. He was listed in fair condition Thursday at a Montgomery hospital. His father, James Eugene Lowery, said the bullet hit his son in the top left cheek and stopped near his voice box. "He comes back from Afghanistan safe and whole. Then he comes home on leave to have rest and peace and this happens," the father said.

Police said Lowery got out of his Chevrolet Suburban when approached by a gunman in the drive-thru lane of a McDonald's restaurant Tuesday night. The gunman shot Lowery, who was then able to get his .45-caliber pistol from the car and shoot his assailant multiple times. Dead at the scene was Thaddeus Antone, 19, of Montgomery.

The fatal shooting is viewed as self-defense and no charges were filed, police spokesman Lt. Huey Thornton said. It will be reviewed by a grand jury following routine procedure.

Lowery, who was on leave until Sunday, serves with Marine Aerial Refueler Transport Squadron 252, based at the Marine Corps Air Station at Cherry Point, N.C.

Lowery's father said the unit flies tankers than can refuel aircraft in flight. Lowery, who got married in January, went to Afghanistan a week later and served there for about two months.

Only one thing to say here RESPECT other peoples property the average lunch bucket Joe is sick of working his a$$ off for his money and having some jerk try to take his property from him!

Too bad the kid made a mistake and is dead but he made the decision to pull the trigger first.

I noticed the Marine was carrying a .45 - multiple shots - that would be really, really loud. As a buddy of mine says who also packs a .45, 'if I don't hit 'em the noise will scare 'em to death'.

Personally, I don't think it's too bad the kid is dead. He tried to kill someone, steal their property - he got what he deserved. One less criminal off the streets.

"Semper Fi" Finally justice is served. You see people are just sick of getting messed with. The nice heartwarming part of this story is that he is from one of my old KC-130 squadrons. NOthing like the ole Lockheed Hercules. OOrah!

Yea, this is great, just think what would have happened if the Marine had not been able to carry a gun.

Says alot for being able to carry a gun for protection, but alot of gun control freaks think American citizens should not be able to defend themselves. If more of this kind of situation happened there would be considerable less crime and we might be able to walk the streets or go to Mcdonalds for a burger and feel safe.

ctownguy, I would be in the number that wants to restrict gun posession, but I gotta admit a story like this makes me rethink that position.

I know, it's a tough call. We can't go back to the old west, but we certainly should have a right to protect ourselves and our families.

With all the kooks out there these days and the way the courts treat criminals like they are the victims, it seems like it's only going to get worse.:shrug:

penguin, Kentucky passed a conceal carry law several years back. Basically you have to apply for the permit, they do a background check (felonies, warrants, etc), and if you pass that then you have to attend some classes that explain the law and also go over basic gun safety. You take a test and if you pass all this then you have the right to carry a concealed weapon.

This does not mean you can carry a gun into a courthouse, a school, a church (although a minister did challenge that rule), or nearly any other public place.

Since the law was passed, violent gun related crime has fallen in Kentucky. The criminals do NOT like it when their potential victim has a fair chance - such as a loaded .45 and the skill and will to use it. (Although I personally don't pack a .45, they're heavy and just too damn loud if you ask me, you can lose an eardrum with those things).

On another note, since the law was passed there has not been one single case of a homicide by a person holding a concealed carry permit. Does that tell you anything?

Yes skinar, it tells me that even though I am not a big fan of Joe idiot lugging around an AK-47 it does not mean that a little protection is a bad thing. I will admit that people with my original point of view get tunnel vision and just say that guns are bad, again the above story makes me re-think that position, that story would have turned out tragically worse if he didn't have a gun and that would have been more wrong than I want to think about.

When you say you can't carry the gun into nearly any public place, what does that mean. If I am out with a permit to carry my gun and I go into a shopping mall the gun has to stay in the car? Elaborate if you don't mind.

pf, basically the rules state that IF an establishment specifically prohibits carrying concealed weapons then you must obey that directive. In your example, IF the mall in question did not have signs that specifically prohibited such an action then you would be allowed to carry your concealed weapon into the mall. Quite naturally, you can't carry weapons into any financial institution.

For the most part there are few restrictions posted by businesses about CCW. As a matter of fact, most of the small business owners that I know would prefer that those people who hold a CCW permit go ahead and bring their weapon with them into the business, just in case the sh*t hits the fan. Any time, and I do mean any time, that a criminal is thwarted in a business because a citizen is carrying a concealed weapon, you generally NEVER hear of any more problems in that business or any business like it - the lone exception being convenience stores. I live in a very small community and some out-of-town hoodlums robbed and murdered a clerk about 15 years ago. Since then, nearly every single store owner keeps a weapon in plain view of the public behind the counter, they have trained their employees in how to use it, and they have instructions to shoot to kill if they are threatened in any way. There hasn't been one single violent incident since those policies went into place.

Criminals are cowards. They will only prey on the weak. When people demonstrate that they are armed, willing, and capable of hitting their target the criminals will go elsewhere.

I know lots of guys with AK47s and related weaponry. I don't personally care for those weapons, they are worthless for hunting unless you're hunting people, but on the other hand they are very adequate for home defense in the case of multiple entrants. They are also a tremendous deterrant, the criminals also know who owns these types of weapons and they wouldn't get within a country mile of those houses.

One more thing though, I live in a very rural area. If everyone in the city had AK47s there would be many problems because those slugs don't pay much attention to walls or anything else. Personally I think the best thing that city dwellers could do for themselves is to pass CCW laws and also issue patches or badges to those people who have passed a gun safety and marksmanship course. It would be like a civilian police force - but the police don't really like that idea for fear of vigilantism, which I recognize could be a serious problem. On the other hand, if enough people began sporting those patches the criminals would soon realize they are greatly outnumbered and may even consider another line of work, or at least a change of venue.

None of this would have anything to do with crimes of passion however. There is no deterrant for that.
