In May of this year Rose Rock says she and her daughter went into this Cracker Barrel in Murrells Inlet around 4:15. After waiting for more than 30 minutes rock says she noticed others who came in after her were served but they were still waiting.

"It?s hard to miss two black people sitting in a sea of white folks we kind of stick out a little bit so you can't say that you didn't see us sitting there," says Rock.

The manager offered Rock a free meal but she decided not to take it. Rock says she then contacted several organizations including the South Carolina Human Affairs Commission and two local NAACP chapters about the incident but got no help. Later Rock received a gift basket and a formal letter of apology from Cracker Barrel.

"I just feel that we have become so passive that if we accept this it's not only going to grow we're gonna be back to where we were in the 50's," says Rock.

"For anyone to think that Ms. Rock and any others are just having illusions or hallucinations is offensive, insulting and trying to sweep away what apparently is a pattern already dealt with," says Rev. Al Sharpton.

Cracker Barrel is no stranger to lawsuits. In 2004 the company paid two million dollars to settle a federal discrimination lawsuit. But the Vice President of Operations Diana Wynne says the incident with Rose Rock is different.

"We made an honest mistake here, not an incident of discrimination but an honest mistake Ms. Rock came into the store during a shift change," says Wynne.

Wynne goes on to say there is not a pattern of discrimination at Cracker Barrel.

"We?re still continuing that investigation and once it's complete if we find that there have been any policy violations the appropriate actions including termination will be taken," says Wynne.

"I would like to see an end to all these kinds of things happening I would like to see the people put on task this shouldn't be a part of their establishment," says Rock.

Sharpton and Rock plan to file a lawsuit in the next few weeks. Sharpton tells News13 others have come forward with complaints at the same store and in others across the country.

As for Rose Rock she says she would usually ignore something like this but because her 21-year-old daughter was hurt she's moving forward. Rose Rock and the Diana Wynne plan to talk about this incident.

During the press conference News13 received a lot of phone calls from viewers with a different view of the incident. One woman tells us she dines at the very same Cracker Barrel on a regular basis and once she had to wait 15 minutes before being served.

"People just want to immediately start yelling discrimination for poor service my husband is in a wheelchair he's handicapped I could've yelled discrimination," says Jane August.
......................................................

It is funny to me how this woman gets Al Sharpton involved and he accepts.

What this boils down to is poor service. Cracker Barrell dont care if your black , white, pink , or yellow. They just suck at service.

The thing about it is, is that they serve a excellant breakfast.

My wife and I were at a Cracker Barrell on a trip to north carolina. We stopped early and the place was packed. We sat at our table that the host sat us at for 20 minutes before we got up and left.

Then about a year ago, we are at a Cracker Barrel in Georgia and we sat for 15 minutes without a word spoken or any sight of a waitress.

We have not been back since. Cracker Barrell is on our list of do not visit places.

So all Cracker Barrell has to do in their defense is have their lawyer show up in court and claim they dont discriminate against anyone, their service just sucks out loud !

For Al Sharpton to hold a press conferance about this , shows what a dumb ass he really is.

They do have good breakfast though, and I like the stuff they sell outside the eating area.

But no more business from me.

I think Cracker Barrel is racist - but the other way around. Easily the most offensive name for a restaurant. Blows Sambo's away.

I don't know if he will understand the intricacies of the discrimination you or I feel. But if the price is right, I think we can get him aboard.

You said it, not me. In fact I'm deeply offended that you've hinted at the notion of a black person being purchased. You've sent us all the way back to the 1850's.:nono: I'm going to sue you as well as Cracker Barrel.

Tawana Brawley

In the Tawana Brawley case, a 15-year-old black girl was found smeared with feces, lying in a garbage bag, her clothing torn and burned and with various slurs and epithets written on her body in charcoal. Brawley claimed that she had been assaulted and raped by six white men, some of them police officers, on November 28, 1987, in the town of Wappingers Falls, New York.

The FBI was called in, and Brawley was questioned about what had happened. She claimed she had been raped by unidentified white men. When a rape exam came back inconclusive, she changed her story, saying that she had not been raped, but had been sexually abused. Further examinations revealed that Brawley had received no real injuries, nor did she show signs of exposure. Testimony from her schoolmates also indicated that she had been at a local party during the time of her supposed abduction.

The incident made headlines nationwide, and her cause was taken up by Sharpton, along with Alton H. Maddox and C. Vernon Mason. The three turned the incident into a media sensation; among other acts, they identified New York prosecutor Steven Pagones as one of the men involved, despite the lack of any evidence, and they likewise attempted to implicate higher officials in the State government.

Accusations continued to be levied; an ex-boyfriend of Brawley's told Newsday that Brawley had admitted to him that she had made up the story of the attack. She may have feared punishment from her stepfather and her mother, who had beaten her after previous runaway episodes. A grand jury was convened, and after seven months of examining police and medical records, the jury determined that Brawley's assault was a hoax.[15]

Disbarment proceedings were begun against Maddox and Mason, and Brawley and her family moved hastily to Virginia, taking with them a "defense fund" of $300,000, which had been contributed by well-wishers.

In 1998, Pagones, whose career and marriage had been shattered, was awarded $345,000 (he sought $150 million) in a suit for defamation of character that he brought against Sharpton, Maddox, and Mason. Sharpton still refused to apologize to Pagones, and one of his friends paid the judgment money.

Al knows how to pick cases to defend.

Wonder who the friend was that paid Als judgement money.

I don't know, that's not how I pictured Eddie Haskell. I was thinking more of a 'To Kill a Mockingbird' lawyer type...

OK, I think we got this one figured out. This is an elaborate scheme to get money from Chris by his sister and Mom. They know that he will finance their fight. It's a ridiculous lawsuit, so they will pocket the money (just like this Brawley chick) and eventually not follow through all the way with the case.

As Rock himself says, there's 2 kinda black people...

And as Kanye says, "George Bush doesn't like black people." ....err, I mean the other thing he said, "I aint sayin she's a gold digger, but she aint messin with no broke ....":sadwave:

If this craker barrel restaurant is one of those all you can eat buffet type of joints it is common knowledge to people in this type of business that a certain group will always make a big mess and rarely leave a tip. There you go Kosar. More material for you so you can label me a racist. I just call it like i see it and this is also a fact of life in these type of joints.

Cracker Barrel is not a buffet. It's a mid-priced restaurant chain that typically clusters in the south very close to interstate exits. I can't speak to how black people tip at Cracker Barrels, unfortunately.

You are a 'special' one, sponge. One of the few left wing loonies who is also a racist and a homophobe. The worst of both worlds, you might say.

Uh Sponge

If your sitting down waiting in a restaurant then
that is not condusive to a buffet line.

Cracker Barrell requires they take your order and then bring it to you, usually about 30 minutes after you place your order.

Maybe kosar is right about you.

Scotty on another note the one here you pay and then you sitdown with your ticket. Now you might have ten servers in the area. One has to get your ticket before you can start to eat. Now when certain groups come in you see kids talking and being in the restaurant business i know what they are talking about. This is what i thought might have happen. Kids i have hired always talk about this.
