It's 9:30 PM. Joe hears some noises outside, so looks through his window. He sees two young boys stealing apples from a tree in his neighbors yard. The boys start to run away with their stolen apples.

Joe grabs his trusty .30-'06 and puts a round through each of their heads, killing them instantly.

What law has Joe broken?

In Texas, Joe has broken no laws at all.:facepalm:

"A person is justified in using deadly force against another to pervent the other who is fleeing after committing burglary, robbery, or theft during the nighttime, from escaping with the property and he reasonable believes that the property cannot be recovered by any other means; or, the use of force other than deadly force to protect or recover the property would expose him or another to a substantial risk of death or serious bodily injury. (Nighttime is defined as the period 30 minutes after sunset until 30 minutes before sunrise.)"

Protection of the Property of Others

"A person is justified in using force or deadly force against another to protect the property of a third person if he reasonably believes he would be justified to use similar force to protect his own property, and he reasonably believes that there existed an attempt or actual commission of the crime of theft or criminal mischief."

Sorry but I love me some joe horn

would love for him to be my neighbor.

He was found not guilty by a grand jury less than six months after both men were killed.

Mr. Horn told the 9-1-1 operator, "They came in the front yard with me, man, I had no choice!" [5]

Police initially identified the dead men in Horn's yard as 38-year-old Miguel Antonio DeJesus and Diego Ortiz, 30, both of Houston of Afro Latino descent. However, DeJesus was actually an alias of Hernando Riascos Torres, 38.[3] They were carrying a sack with more than $2,000 cash and jewelry taken from the home. Both were convicted criminals from Colombia who had entered the country illegally, and were members of an organized burglary ring in Houston.[1] Police found a Puerto Rican identification card on Ortiz while Torres had three identification cards from Colombia, Puerto Rico, and the Dominican Republic, and had been previously sent to prison for dealing cocaine and was deported in 1999.[6]

A plain clothes police detective responding to the 9-1-1 call had arrived at the scene before the shooting and witnessed the escalation and shootings, while remaining in his car.[3] His report on the incident indicated that the men who were killed "received gunfire from the rear".[1] Police Capt. A.H. Corbett stated the two men ignored Mr. Horn's order to freeze and one of the suspects ran towards Joe Horn before he angled away from him toward the street when he was shot in the back. Note: The medical examiner's report did not specify they were shot in the back.[7] Pasadena police confirmed that the two men were shot after they ventured into his front yard. The detective did not arrest Horn.

So you think interfering with the police and shooting unarmed people in the back is A-OK.

And if some Joe killed you kid for stealing apples, that would be A-OK too?

I think the Joe Horn incident's a tough one for a lot of people Duff, because most would want Joe for a neighbor and it's hard to feel sorry for the two scumbags he shot... but damn, he had itchy trigger finger.

Most people on the line with a 911 dispatcher, knowing the police are on their way and being in no imminent danger themselves, would not have intervened. Joe alluded to the Castle Law during the 911 call and was intent on using it to justify his use of deadly force.

The Castle Law varies from state to state.

In CA, if the "Scumbags" as you put are attempting to flee, you CANNOT "Dirty Harry" the "scrotes"

I have been thru the proper training, I know my rights as a home owner. I am not a gun slinger like most think I am. I have other means of protection and security for most situations.

If you pay attention to the Joe Horn tape, you can tell that he's just itching to use that shiny new pump gun he bought a few days earlier.

Joe is in no danger, nor is anyone else. He is protecting no one, countering no threat.

Joe knows the police are on the way.

I'll bet shucking that pump gun gave Joe a stiffie.

But I can't help but wonder if the two perps had been suburban white boys, if Joe woulda shot 'em.
