Recently, a little over a month ago I bought a tivo on ebay for $80. I emailed the seller and she said she would have it out to me ASAP. Anyway, 3 weeks go by and still no tivo. Emailed the seller again and she said she had some family problems and would get it out to me ASAP. I said OK but get it out soon please b/c I would really like to have it for Thanksgiving weekend. Thanksgiving comes still no Tivo, I emailed here and asked why I have not seen it yet?? Where is it?? No response. Kept on emailing her no response. Notified paypal and ebay and they don't seem to want to do shit except "launch an investigation." I have her name, phone number, city and state, and proof of payment. I have called her and left messages as well - no response. Should I call the local police dept or what should I do from here??? Any suggestions????

If she ends up stiffing you i would get every free mailing from the internet I could find sent to her home address. It would be a huge flood of crap...i've heard doing so can cause someone big headaches.

QUESTION:

I have only bought something on Ebay twice and both times turned out ok. By sheer coincidence the first purchase turned out to be a guy that was about ten miles from my house and I drove down and picked the item up. weird huh?

Anyway since so many people get ripped by Ebay, why doesn't PayPal hold payment until the Buyer reports they've received the item and all is good?

you can put in a complaint in paypal and they will take the money from the seller until they resolve the issue with you, look on the sight can't rememeber exactly where.

lawtchan,

...different eBay question, but I would love to get your opinion.

...had a winning bid (only bid) on an item. 2 min before auction is over. someone bids, a dollar short of my max bid...then immediately bids up increments (2) til they won item.... I'm thinking I got sniped, no big deal....

Fine by me, whatever, right?

...then I get an e-mail saying "second chance" to buy the item at "my" max bid...because the buyer backed out or something.... I'm thinking that the seller was using bogus name to bump price and then try to get my max bid.... Would you report this asshole?

yeah, sometimes seller's can do this, but people can see thru this if done multiple times. Check his feedback score, to see if anything said about it in the past.
Unfortunately, he/she can open different accounts, or go to a "friend's house" and crank up the bids.
I would stay away from this seller, He/she is probably doing what you are saying

maybe this link can help:

taoist,

I had the same thing happen to me, however I think the sellers are on the up and up by offering the "second chance" because it is in the Ebay FAQ, but there is a huge hole for abuse and price bumping. However what I did not like about it was it was @ my max bid and not my most recent bid (I basically told the guy to shove it up his a** and go get his money from the other guy). I feel that I was sniped as well, what is funny is I looked @ the history of the person who had beat me and all of the auctions that they had won were won in the 11th hour of the auction (e.g. 11 seconds to go). I sent an email to Ebay asking for some sort of explaination of how I lost the auction and never rec'd a response. I have worked in this industry for many years and grew up and went to school in the SF bay area and have many ties to the valley. Since Ebay did not respond this prompted me to do some reasearch on sniping, it was very interesting to say the least. I am done with Ebay.

Hard to get response from ebay or paypal. Their numbers are purposefully nearly impossible to find, and their CS is a joke.

Had a similiar problem spent about two houndred bucks on some direct tv equipment, guy kept giving me the run around and after about a month his email account was gone. Luckily, I had his name and address, but I went through all the shit with EBAY and PAYPAL and got nothing resolved and got completely frustrated. So at this point I began to call the guys number and leave message after message usually around ten a day and still no response. I then contacted my attorney whom knew a lawyer in the sate where this person lived and for twenty five bucks they filed a suit in small claims against this person just to scare them. Nonetheless, two days after this suit was filed amazingly all of the equipment showed up overnighted at my home with some additional equipment. Since, this happened I will not buy from anyone on EBAY whom is a newbie or has a rating score below 98%, because EBAY and Paypal are worthless. Just another note, if this person would not of been scared I would of more or less been shit out of luck as I would have had to travel out of state to pursue this but it worked out in the end.

ryson, what did you find out? i've only had a couple of bad experiences (both on small $$ items)on eBay and both were eventually resolved.... like mc said, i avoid low and bad feedback folks and haven't purchased any $$ items.
