I have a problem.

Fletch since you live in the neighborhood maybe you can even help me out here.

Late last year my kids inquired about me buying them a basketball hoop, due to the fact many of their friends around our neighborhood had them. I called the HO office and they stated there wasn?t a problem with it. I then went out a purchased a new $260.00 basketball hoop.

Three months later I received my first, and only, courtesy notice. It stated my basketball hoop couldn?t be placed on the sidewalk due to the blockage of pedestrian traffic. (what traffic ?? I live in a circle)
Granted I should have known better than that in the first place.
Anyway I called the HO office and she said ?place it closer to the house, like others in the area, and it would be okay?. I immediately placed it more than halfway up my driveway.

Today I received a second notice,
stating the I was in violation..
What do you want me to do now ?
I drove around our neighborhood and within a half mile radius to find out how to correct my problem.
I observed 14 portables and 7 permanent basketball hoops (6 of which are in one cul-de-sac alone). Some hoops were laid across the sidewalk but most were in the property owners driveway. Two homeowners were in their yards and I asked them if they received a courtesy notice and both replied ?never?.
I?m not stating that I?m being discriminated against. hmh

Maybe to be on the safe side they could tell me the maximum amount of distance from house to hoop is so that I am not in violation.
I believe some in my cul-de-sac is bitching but haven't a clue who they are.


Anyways thats my problem.

we're gonna have one of those things. there are 19 lots with 11 sold. as soon as 15 are sold, we form the HOA. the builder is gonna nominate me for pres. this could be interesting :D

so far, i am the only house here with one other being built and should be ready in october. see what happens.

i have been on about 4 hoa's board, & quit them after i learned about the communities & who i was dealing with. i learned that all of these boards are the same.

i have found that every community has someone who feels it's his obligation to rat out neighbors who they think is violating the ccnr's.so i think that a neighbor is complaining about the hoop.maybe this neighbor doesn't like the noise of the ball bouncing off of the ground. believe it or not there are people who are like that.

you need to put any requests in writing, & make sure that they answer you in writing.

the first thing you should do is see if there are any rules about basketball hoops in the community ccnrs.some rules state that basketball hoops can be used in the homeowners driveways, some state that they can be used in the driveway only during basketball season, some state that they can be used between certain hours. some rules state that the hoops can only be used in the homeowners backyard.

if there aren't any rules about basketball hoops i would recommend that you drive around your community & list the addresses that have hoops. then write the hoa a letter listing all of your neighbors(by address) & send them the letter certified return receipt requested. you should also request that they answer you also by letter, since you can not believe what they say.this usually gets them nervous, & they may back away. if they don't you have to go to step two.

Take pictures of each and every one of the others. Then ask for clarification of rules. If there is evidence that you are being singled out, I'd show the pictures. But you risk stirring up more trouble because as petty as these HOA's are, they just might come down on everybody and people will blame you.

call them and tell them it is not in the rules and regs we went through this shit last year 3 times at the home owners meeting , what the want you to do is roll it out when they play and put it up against house when not in use but half or more then half leave them right at the edge of the drive way. tell them they are a new company and to lay off that's why benchmark is not here anymore and the guy the goes around is some old fart feel like i am back in fl with the condo comandos from new york who will go to the early bird special and bitch yet steal all the sugar and salt and pepper shakers they can get in their damn hands ft.lauderdale really not where i am now in new smyrna beach but lauderdale every blue hair with that screeching voice would stuff their purse, if you see him tell him to f-off i did over a trash can that was not the right size you own the house and would be backed in court i had my attorney send a letter and have never had te pricks step foot on my driveway again, meeting coming up at the rec center if you want to see some good fights:D
