What am I missing in this picture. Am I wrong in thinking illegal immagrants are suppose to be deported back by law and not offered rewards???

Lawmaker Sparks Immigrant Licensing Debate

WASHINGTON ? Congress on Tuesday was wrapping up work on an intelligence reform bill that skirted the issue of whether states should issue driver's licenses to illegal immigrants (search), but outside the Capital Beltway, neither side is backing down.

Opponents of allowing illegals to obtain licenses say the issue is clearly one of security ? a driver's license is a ticket to move freely around the country, and by offering the illusion of legal citizenship, it would allow terrorists to lay low and build networks until it's time to attack.

"It is common sense we need to control that," said California Republican state Rep. Mark Wyland. "The problem is there are those who want to be politically correct, or have an agenda and they are the ones who are pushing this. This is a crucial national security issue and fiscal issue for this country."

Immigration advocates say the warnings are merely fear-mongering. Up to 12 million illegal aliens live in the United States. Most work, many drive. In the interest of public safety, they should be licensed.

"Each state has to decide how it wants to go about the process of licensing people to drive motor vehicles on its roads. I do believe we have to make sure that states are not too lax," said U.S. Rep. Javier Becerra, D-Calif.

Critics warn that some states make almost no effort to confirm applicants' citizenship or visa status. They want mandatory federal standards stating the types of documents the states can accept.

Currently, 11 states do not require applicants show proof they live in the United States legally. Ten other states accept foreign birth certificates and ID cards, which critics say are easily forged.

Most other states accept a U.S. Social Security number, despite studies that show undocumented workers can easily get valid numbers belonging to U.S. citizens.

Rep. James Sensenbrenner (search) , R-Wis., chairman of the House Judiciary Committee, wanted to include immigrant licensing rules in the intelligence reform bill that has been debated in Congress for months. House leaders decided to leave out the issue and return to it at the start of the 109th congressional session.

Sensenbrenner argues that a license is only as good as the document used to obtain it, and states that accept foreign ID or matricula consular (search) cards, issued in Mexico, have no way of knowing if the cards are valid or if the person presenting it is legitimately in the country. A FOX News producer was recently able to obtain a matricula consular card on a street corner in Los Angeles.

Supporters of licensing contend that giving licenses to illegal immigrants actually enhances security. And, they add, Sensenbrenner's provision is so restrictive, it in effect creates a national ID system where states have the authority to issue licenses.

"Should the federal government, in essence, issue driver's licenses for 290 million people or should the 50 states be responsible as they have been?" Becerra asked.

Polls in California and Arizona show a majority opposes issuing licenses to illegal immigrants, arguing the permits legitimize and invite more illegal immigration.

Day laborers in Redondo Beach had their day in court Monday, and won -- temporarily, at least -- when a federal judge ruled that they can't be arrested for soliciting employment on public streets and sidewalks.

U.S. District Judge Consuelo B. Marshall issued a temporary restraining order against the city of Redondo Beach, preventing officials from arresting, warning or fining the workers, who have been targeted by police in recent months for violating a 15-year-old city ordinance limiting where they can solicit work.

In her ruling, Marshall wrote that "there are serious questions as to whether (the city's ordinance) is constitutional.

"The hardship that day laborers face due to possible arrests, fines and loss of livelihood outweighs the potential disruption of traffic flow and quality-of-life issues asserted by the city," she added.

The restraining order will remain in effect until Monday, when Marshall will rule on whether to grant a longer-lasting preliminary injunction against the city.

Lawyers for the Mexican American Legal Defense and Educational Fund, which filed the lawsuit against Redondo Beach on behalf of the workers, said they were pleased with the decision.

"We feel like we have a really strong case," said MALDEF attorney Shaheena Simons, adding that she feels confident the judge will grant the preliminary injunction next week.

Jerry Goddard, city attorney for Redondo Beach, said the ruling was disappointing.

"We see this as a substantial safety issue," he said. Day laborers often run into the street to solicit business, causing traffic hazards, he said.

"I know that people are seeking employment, and I applaud that ... but streets are for people to drive on. If the court says we can't enforce this ordinance, it's going to create a safety issue," Goddard said.

MALDEF filed the lawsuit in mid-November after some of its attorneys marched with hundreds of day laborers to protest stepped-up enforcement of the city law. Plainclothes officers began conducting sweeps in August in response to increased complaints from local businesses, and dozens of workers were arrested and fined after hopping into cars with undercover officers.

Thomas Saenz, MALDEF's lead attorney on the case, argued that while the ordinance banned an array of otherwise legal activities, it had only been enforced against day laborers and thus violated their First Amendment rights.

"It's difficult to see the ordinance as anything but targeted against a specific group," Saenz said. A fund-raising high school car wash with students urging motorists to pull over should be impacted, but isn't, Saenz said.

While the livelihood of the day laborers could be severely hurt by Redondo Beach's ordinance, the city had other options for enforcement, Saenz continued. If the city bars workers from streets and sidewalks, they may have nowhere else to go.

"In parking lots, it is distinctly possible that private owners ... would seek to ban day laborers," Saenz said, adding that the city's "concerns with the flow of traffic could be easily addressed with existing laws."

The attorney who represented Redondo Beach in court Monday, Gene Ramirez, argued that the city wanted to regulate traffic hazards, not free speech.

"We're not opposed to day laborers," Ramirez told Marshall. "We're just opposed to the way they do it right now."

The ordinance is based on a Phoenix law that was deemed constitutional by the 9th Circuit Court of Appeals in 1986.

"If it's good enough for the 9th Circuit in Phoenix, it's good enough for Redondo," Ramirez told the judge.

But Saenz argued that decision is outdated and differs in many respects from the Redondo Beach case. Marshall said his reasoning "raises serious questions" about the Redondo ordinance.

I'm in total agreement. It just looks like yet another case where our leaders sacrificed our security and best interests for the sake of keeping things nice and easy for big business. It's inexcusable that they did not include the licensing and borders issues in the legislation.

big business has nothing to do wtih it....government only cracks down on big business in regard to hiring illegals....the small contractors are the winners in this scheme....

pandering to the Hispanic vote is what drives the government's blind eye to illegal immigration and sadly Bush has led the movement to disregard this HUGE problem in the only party that once fought against it.....

Pandoras box---it appears from my view you now have the republicans trying to garner the hispanic vote to offset the 90% democratic black vote.Which I think was HUGE factor in BW's win.
Just hope they don't start paying them for support like Kerry did.

Saw two guys debating immigrant labor last night and you had the one with his blah blah blah bout needing it as there is no one else here that will do those jobs--the other put up charts showing data from years before influx of illegals when we had same jobs that were filled by americans only at higher wages.
The other guy had no comment!

the 19 hijackers had 63 drivers liscences between them. freakin disgusting that some of our leaders have no balls. we have a republican dave dreier who promised that he would not vote for that and he did. that guy is gonna get so harrassed, he will be sorry.

I'ts both the vote pandering and the short term benefit to large and small employers that keep anything from being done about illegals. If it was only Democrat vote pandering, then the Republicans would have been doing something about it a long time ago. It's not like before Bush wanted the hispanic vote, the Repubs were guarding the border any better or cracking down on sweatshops.

I'm right with you again. That's why I'd love to see a raising of minimum wage combined with serious crackdown on illegals. We have the workforce, they just need to be paid decently. It could allow us to eliminate Earned Income Credit and slash welfare and unemployment to boot!

Yep, what more can be said? If a similar attack happens again, every single member of congress who did nothing on this legislation should be exported to the frontlines. They're simply rolling the dice that it won't happen again.

Where the illegals are going to is the South. I don't mean out West. The old South. There the modern day slaves for places like Ark, Georgia, Tenn, N Car. Ark, by it self in last two year has had a 800% increase in folks from across the border. N Car over 600% that one really surprise me. Hey no one else will work for 3 bucks a hour. Just have to watch L Dobbs to learn about the exporting of our jobs and the influx of illegals. Just nuts what some out fits get away with. Starting with Wal Mart.

when the next terrorist catastrophe hits the mainland,i`ll bet a dollar to a donut it will be traced back to our porous border situation....

it ain`t business as usual,gentlemen........the stakes are way to high....

a national i.d. card?....i`m fine with it...i`ve got nothing to hide....
