Oh come on now. A student at Ball State participates in a "tear down the goal posts" session after a football game. The goal post snaps. Student is injured .. paralyzed. Family sues goal post manufacturer.


Injured student sues goal post maker

A man whose legs were paralyzed when fellow Ball State students toppled a goal post after a 2001 football upset of Toledo is suing the goal post maker.
Andrew Bourne, 23, of Liberty, Ind., and his parents are suing Marty Gilman Inc. of Gilman, Conn., claiming the aluminum posts were "designed and constructed in a manner which allowed them to suddenly snap and collapse."

The suit says Bourne was in the end zone when he was struck and that he suffered a broken leg and vertebrae "resulting in paralysis."

Company President Neil Gilman said Monday that he had not seen the suit and declined comment.

Attorney Scott Montross, who represents the Bournes, said Monday that the family is "very close to resolution" of a settlement with the Muncie, Ind., school.

maybe when he gets that fat settlement check he can pay the vandalism and destruction of property fines he should be receiving.

I'll tell you right now, he will be compensated since the 3rd party is liable....

The smart thing to do as fans walk into the stadium is have them sign a release form.... too much hassle though.....

I thought tickets to sporting events had disclaimers on them for such occurrences. I remember seeing one on a PGA ticket so you can't sue if you get struck by a ball or trip and fall.

In todays "it not my fault society' no one is resposible for their actions. You continue to smoke after warnings-you eat too much-you break into someones home and get shot-you vandalize goal post ---and if you can get venue in California chances are it will go to court regardless of merit--and the real prob is the jury once it gets there---they will prob award the goal post fellow 50 million minimum then whine about their insurance premiums going up.:shrug:
They just can't get it through their heads that these huge settlements are invariable passed on to the consumer via price increases.

Since the parents opened the door to talkl about what the posts were designed to do, I wonder if they will talk about how they are designed to standup to 100 kids pounding up and down on them. I mean, of course they arent designed to just snap and collapse randomly, when have you seen a goalpost just fall over on its own accord? Theyre designed and built to just stand there.

Unreal, I hope they give the kid a big smack in the head and then tell him to stay off the damn field.

As an attorney, I hate hearing about sh*t ball cases like this. I hate it that the kid got paralyzed, but DAMN, if his ass wasn't on the field under the goal post, this wouldn't have happened. Give me some assumption of the risk here. What the f*ck are goal posts supposed to do with 100 kids jumping up & down on them?

Exactly. And since chances are the kid has watched football before and knows what happens when students rushed the field, he certainly knew the posts would come down.
