been very frustrating
on mar 16 my handicap van was total. noone hurt, not my wifes fault
van was all automatic. push button for everthing, kneeled-lowered when lift came out.etc
to replace ive checked mobility places is 18 to 23k for similiar
ins co of guy at fault 1st offer was 11k, they dont understand concept of the things done to a van to make handicap acc and depreciation is not same, we pd 20k to alter in 2008, ins has come up to 13.8 k with nuther offer coming mon

my question-since wreck not our fault why should we lose money, is playing lawyer card good option :shrug:

Thanks Jack, but EXPERT is far from what I can offer, but I will offer some basic suggestions that should help expedite this a bit.


First of all, you are on the right track as that you haven't agreed to the first offer. Please do not sign off on anything until you are completely satisfied. They cannot just leave you out in the cold until you sign a final release.

Secondly, you said that "no one was hurt", while this sounds great in theory, that's where hiring an attorney can be difficult. Most attorneys make their money off of the injury, pain and suffering side of things. At least those are the ones that won't charge you anything and will only take a portion of what they recover for you. "Hiring" an attorney to fight with them, outside of the personal injury side of things, is a possibility, but it will be a different kind of attorney and they will charge you a flat fee or hourly which will cost you $$$$ to go that way.

What you need to do immediately is get "your" insurance agent involved. You don't only pay them to cover your loss in the case of an accident, but they are paid to protect you in any automobile accident. They will step in and make the call for you to the other insurance company and try and work things out. If the other company is still being unrealistic, your insurance company has a team of lawyers on staff that will, or at least should, take it from there. This route should get you brought back to square as quickly and efficiently as possible.......

If they are a shit ass company and aren't willing to assist you, then, and only then, do you pull the attorney card from your back pocket.

You can get this resolved, but insurance adjusters are trained to pay out the least amount possible in every single claim. Their bonuses are based upon that. And unfortunately this will take longer than you want it to, but that's the way insurance is and thems the rules we have to play with.

Keep in mind as well, even if you did have full coverage on your vehicle, your own company would only pay you what it is worth today (depreciation) and not what it would cost you to buy a "new" one.

Before saying anything else to the other insurance company, I would ring a couple of local attorneys and just give them the scenario and see how receptive they are.

I bought a new pathfinder...I think it was 99` or 2000`...was hit broadside coming out of a shopping center by a lady on her cellphone a few years later..pathfinder was totaled.... had very little mileage on it(under 10 grand)...wasn`t really injured all that severely(I was knocked out and was lumped up but that was it...and like an idiot,i didn`t feign a bunch of injuries and do months of unnecessary rehab)....so I ended up taking a bath on the deal...

you don`t want to be a shit and take advantage of the situation....but if you don`t,you end up getting screwed....great system....live and learn...

I think Insurance companies are some of the biggest scam artists in our country. So we basically pay high coverage all these years and then when you actually need it they underpay, make your life a pain in the ass, and then at the end of it all raise your premiums.

Do you happen to know if there are any provisions in the Americans With Disabilities Act that would make this discriminatory practice by the insurance companies failing to cover your accessible van? You'd hate to even go this route but they are forcing your hand.
