A friend of mine emailed me this asking my opinion, since I have no knowledge I am not able to answer. Hope you guys could help me out here....

Congress enacts a law that entitles citizens to inspect any federal file containing information pertaining to them. The White House requests background information from Abby Appeal explaining that she is being considered for appointment as a federal judge. The President thereafter asks an advisor to comment on Appeal?s credentials. The advisor rails against Appeal and the President appoints someone else. Appeal hears a rumor that a presidential aide killed her appointment. Appeal?s request to see the papers pertaining to her is denied and Appeal then brings an action to inspect the file under the described act. What is the President?s best defense?

1- As applied in this case, the inspection law would prevent the President from receiving frank and generous advice.

2- The inspection law interferes with a presidential aide?s right to privacy.

3- Congress lacks power to grant public access to private information.

4- Sovereign immunity bars Appeal?s suit.

the best defense would be to claim executive privilege, which is embodied in answer no. one.
