Any Madjackers familiar with the law or this situation, your input is greatly appreciated.
My cell phone carrier had an employee who used his position at one of there retail stores to obtain personal information. With this information he bought/leased a motorcycle using my wife's credit. He allegedly is now serving in the military but has stopped making payments on the bike. The creditor is now calling my home looking for payment or the bike.
The interesting part is my wife and I were turned down for a small personal loan shortly after the bike purchase. We were hoping this loan would help us consolidate our bills, mostly credit cards, and allow me to pay off school. We have subsequently suffered some severe financial difficulties and were wondering if the cell phone carrier could be held liable through vicarious liability?? My spoke to a lawyer in passing who said no lawyer in the state of New Jersey would touch it because it is a fraud case against a large company. We would be better suited to let the local attorneys office handle the matter. Only problem I have with this is that in legal terms my wife and I have the right to asked to be made "whole" again and I don't think the local attorneys office will care about that factor.
Any suggestions advice or past horror stories are all appreciated.
