Pulled over charged with DUI:facepalm: Trooper ask would I let the EMT draw blood I asked for Attorney never seen one spent 12 hrs in Folson Prison now charged with Implied Consent automatic loss of license for 1 yr:facepalm: I have a lawyer now and he has talked to trooper and DA and their willing to drop DUI but I think I maybe fuked on implied consent. If they drop DUI how can they not drop implied concent?? Could they drop that charge to a lesser charge? My lawyer is out of town all this week. Any input appreciated:0008

Theismann, what state are you in. IMO you're lucky they're willing to drop the DUI and just keep the IC. Depending on your state and how drunk you where you could be looking at a felony rather than a misdemeanor. Say thank you and walk man.

Sorry man... What did the lawyer say you should have done when pulled over? I've often wondered what the best course of action is if you know you're over the limit.

He said I did the right thing By asking for attorney I never said I would noy comply but I wanted a attorney Present but they just cuffed and stuffed me I guess a fifth empty bottle in passengers side seat didnt help much:shrug: When I went the next day to get my car from storage the bottle was still in the seat:142smilie :142smilie :142smilie

The privledge to drive a motor vehicle is completly different from the criminal charges of DUI.

In most all states, they have an implied consent law when you sign for your driver's license which states that if you are pulled over with reasonable suspicion and the officer has probable cause to ask you to take a blood or breath test, you either have to consent to the test or you lose your privledge to drive a motor vehicle for a set period of time, in Colorado where I practice its for 12 months. The only thing the DMV needs to establish is there was a reason to pull you over, the tests were offered and you refused. Case closed suspended license.

My advise on how to handle being pulled over for DUI, is No, No, Blow. Which means No to all questions, no to roadsides and PBT and take the breath test after the alloted waiting time, as an intoxilizer is often times more wrong then a damn blood test. Plus if you blow below the legal limit the officers will more than likely take you back to your car, with blood you dont know right away and go to the slammer.

Just my random thoughts on this issue.

I agree with others, dont drive and take cab, much much cheaper in the long run.

knew a kid, was drunk decided to drive home from a party, ran a stop sign, killed a woman...(his only trouble with the law) 5-10 year sentence....good bye life and conscience

you are fortunate, take the year and look into Joker's new job he found that you can do from home and make $283,000 a month
