The privledge to drive a motor vehicle is completly different from the criminal charges of DUI.
In most all states, they have an implied consent law when you sign for your driver's license which states that if you are pulled over with reasonable suspicion and the officer has probable cause to ask you to take a blood or breath test, you either have to consent to the test or you lose your privledge to drive a motor vehicle for a set period of time, in Colorado where I practice its for 12 months. The only thing the DMV needs to establish is there was a reason to pull you over, the tests were offered and you refused. Case closed suspended license.
My advise on how to handle being pulled over for DUI, is No, No, Blow. Which means No to all questions, no to roadsides and PBT and take the breath test after the alloted waiting time, as an intoxilizer is often times more wrong then a damn blood test. Plus if you blow below the legal limit the officers will more than likely take you back to your car, with blood you dont know right away and go to the slammer.
Just my random thoughts on this issue.
I agree with others, dont drive and take cab, much much cheaper in the long run.
