Man Sues Doctor (And Wins) After Waiting Three Hours To See Him

LAS VEGAS -- Aristotelis Belavilas got so fed up waiting three hours to see his doctor that he left and headed for his lawyer.

Belavilas, 58, sued Dr. Ty Weller for $5,000, saying he wanted to teach him a lesson about treating patients with respect. A small claims court in Las Vegas this month awarded Belavilas $250.

"My time is worth something just like his is," Belavilas said.

Weller, a pain management specialist, said he was "appalled" by the outcome.

"Even more important than the money is that now I have to worry about other patients doing this to me," the doctor said.

Weller said he was overbooked the February day he scheduled Belavilas for a back pain injection, but said he was trying to accommodate Belavilas before the patient left on vacation.

"I can't hurry a patient along who needs my attention just to be on time," Weller said.

Belavilas said his appointment was for 2 p.m., but Weller didn't show up until 5:15 p.m.

The doctor "didn't say he was sorry and that he was with another patient or that he had gotten a flat tire," Belavilas said. "Nothing."

Weller said he'll appeal the decision. He's been ordered to pay a total of $365 to cover Belavilas' judgment and court fees.

At our clinic if you have not seen the doc in 30 minutes of your sched app. And no one from his staff has came out and said why the delay. Clinic Management wants to know about it. Said it's way only to help solve delay problems, and see what area they may need to beef up. Said another way. See if same doc's are just slow or maybe really need alittle help. There motto is your time is worth money to.

suing just to "teach some a lesson" is ridiculous

if we all sued to "teach someone a lesson" we all would be suing and getting sued each and every day...

i would tell the plaintiff to find a different doctor if he didn't like the wait....dangerous precedent thats being set.

DJV's doctor has a patient-friendly policy....this is best way to control the problem -- go to doctor's with these policies or something like it

doctors are targets for lawsuits...here is another classic example...

why don't we sue checkout lady for taking too long, or Walmart for not having enough people to checkout when there are long lines?

I wonder how this same a$$hole would feel if the doctor rushed his visit to make sure the next patient was on time. Then he'd be b*tching about the "quality of health care".:thefinger
