First, he explains here that, based on policy, the investigation COULD NOT charge a sitting President with a crime. Nor could they seal those charges for a later date.

Second, he has to come out and refute the the response from Barr because, based on the above policy, the fact that they did not charge the President with a crime DOES NOT constitute his innocence.
