taking a photo while having the face covered defeats the purpose. i can't see this woman winning her case, especially after 9/11.

ORLANDO, Fla. -- Florida's refusal to issue a driver's license to a Muslim woman unless she is photographed without her veil violates her religious rights, an ACLU attorney argued in court Tuesday.

The requirement by the state Department of Highway Safety and Motor Vehicles is a burden on Saltaana Freeman, a 35-year-old convert to Islam whose religious beliefs require her to keep her head and face covered out of modesty, said Howard Marks, an attorney for the American Civil Liberties Union of Florida.

"This is about religious liberty. It's about whether this country is going to have religious diversity,'' said Marks at the beginning of Freeman's nonjury trial. "Allowing the state to chip away at religious liberties is not a path we want to go down.''

"There's no dispute in this case, your honor, that my client came to Florida in February 2001, was issued a Florida driver's license persuant to the rules and regulations in place at that time," Marks said. "The testimony is going to be that the law has not changed."

Marks also pointed out that Florida has issued more than 800,000 temporary driving permits in the last five years without photographs. And that some of the driver's license photos are 18 years old and barely resemble the card holder.

But Assistant Attorney General Jason Vail argued that having an easily identifiable photo on a driver's license was a matter of public safety since the photos are used during traffic stops, in financial transactions and to prevent identity fraud. Vail said there are limits to the religious liberties extended in the Florida Constitution if public safety is at stake.

"It's the primary method of identification in Florida and the nation,'' Vail said of the driver's license. "I don't think there can be any doubt there is a public safety interest.'' Circuit Judge Janet C. Thorpe must decide whether taking the photo would violate Freeman's religious beliefs and if the state has a compelling interest in not allowing her to obtain a license with her covered face in a photo.

In February 2001, Freeman obtained a Florida driver's license that had a photo of her face covered in a veil, but she received a letter from the state nine months later warning that it would revoke her license unless she returned for a photo with her face uncovered.

She refused and sued for the right to get a driver's license with a photo showing her face uncovered.

Her attorneys argued that state officials didn't care that she wore a veil in the photo until after the Sept. 11 attacks, an allegation denied by attorneys for the state.

Florida attorneys plan to call Islamic experts to the stand this week to testify that it is not mandatory or a sin for a Muslim woman to show her face for a state issued photograph, according to Local 6 News

Local 6 News also reported that the state also plans to submit into evidence a Time magazine photo of Elizabeth Smart that shows part of her face veiled. Attorneys would not comment on why they want to use the photo but there is speculation that they will use it as an example that a veiled face could hinder identification for authorities.

Unbelievable, who in there right mind would represent this woman???? Come on don't you think that this sh*t is going a little to far geeeez..............

I believe that each person has the right to pick and choose what religion they want to practice "if any", but the laws of our country should cover this kind of out rage. Whats the point of taking a picture at all if she got her face covered up??? and for her to fight this :shrug: she must not care about public safety herself I say REVOKE her license all together.............

THEY SHOULD CUT HER HEAD OFF LIKE THEY WOULD IN HER OWN COUNTRY IF SHE SPOKE OUT AGAINST HER GOVERNMENT AND TAKE THE PICTURE OF HER HEAD SITTING ON THE TABLE THIS WILL KEEP HER QUITE FOR GOOD.MAN THE BALLS OF THESE GOD DAM MUSLIMS :jump:

It was all so easy once. Had these 8/10 white guys set down have a few beers. Then came up with the laws of the land. Did a good job considering not much was happening then. Got to think most would chit there pants if they saw what goes on now days.
Even the slaves were freed. Chit they would have to polish there own shoes. Florida they would have left with the Indians. :D :D

And now we here more. First they do not use a license as a ID card in Florida. And last year they issued over 750000 temporary license for all ages of folks learning to get there permanent license. Or they just moved into Florida and get temp until approved for permanent ones. No pitcures are used on these. So no big deal. Just make sure her ID card has the vail down. That is if she needs one. Who the hells knows. Florida has strange things happen.

that in most muslim countries,you have to have a full faced photo on your driver`s license.....because we are a free society,with individual rights,we have to put up with this inane b.s......

they need to change the system so the loser pays all court costs and can be assessed some sort of penalty for frivolous lawsuits..... again,in america,the tail wags the dog.....

Woman suing over veil revealed
as kid-beater

A Muslim suing Florida for denying her a driver's license because she refuses to take a picture without her veil, once had her bare face photographed - for a police mug shot.
Sultaana Freeman, 35, who claims her constitutional right to religious freedom is being violated, was photographed without her veil by Decatur, Ill., police who busted her in 1997 for battering a foster child.

Freeman's mug shot was unveiled yesterday by Court TV's thesmokinggun.com, which posted it on its Web site.

The woman pleaded guilty in 1999 to felony aggravated battery and was sentenced to 18 months' probation. As a result of the conviction, state officials removed two foster children from her care, thesmokinggun.com revealed.

Freeman, born Sandra Keller, was arrested after her conversion to Islam, according to the Web site.

She sued the state of Florida after it revoked her license in 2001 when she refused to have her photo retaken with her face uncovered. Her previous license showed her veiled with only her eyes visible.

The state's attorneys contend a terrorist could use the excuse of religion to obtain a driver's license with his or her face covered.

'Religious zealots'

"The sad fact is our country, our society, is under assault by puritanical religious zealots," Assistant Attorney General Jason Vail told a judge hearing Freeman's case this week.

Freeman appeared in court wearing a headdress that only revealed her hazel eyes.

But Howard Marks, Freeman's American Civil Liberties Union attorney, countered that Freeman "needs to drive to take care of family needs."

"But she isn't going to violate a fundamental religious belief," Marks said.

AR not sure if any of that matters. If they do not use it for ID card in Florida. Not sure why anyone has thee pitcure on them. And with over 750000 issued last yerr for Temps up to 8 months. None have pitcures on them. Florida just seems to have so many back and fourth issues. Make the darn thing the ID card also and be done with it. But why do I think that would cause a loss in revinue to the state. Charge for the ID card and charge for the License.

we are living in a different world now....past practices may have to be changed...2 wrongs do not make it right....florida needs to adjust it`s rules across the board.....so miscreants can`t abuse our system.....the state appears to be taking a stand...and a smart one(imo).....

didn`t take the aclu long to get it`s smarmy paws on this one.....i hope she loses the case......the aclu always seems to get involved in the absurd and whiffs on the obvious...

ORLANDO, Fla. - A Florida judge ruled Friday that a Muslim woman cannot wear a veil in her driver's license photo, agreeing with state authorities that the practice could help terrorists conceal their identities.

After hearing three days of testimony last week, Circuit Judge Janet C. Thorpe ruled that Sultaana Freeman's right to free exercise of religion would not be infringed by having to show her face on her license.


Thorpe said the state "has a compelling interest in protecting the public from criminal activities and security threats," and "having access to photo image identification is essential to promote that interest."


Freeman, 35, had obtained a license in 2001 that showed her veiled with only her eyes visible through a slit. But after the Sept. 11 attacks, the state demanded that she return to have her photo retaken with her face uncovered. She refused and the state revoked her license.


Freeman sued the state of Florida, saying it would violate her Islamic beliefs to show her face publicly.


Her case was taken up by the American Civil Liberties Union (news - web sites), which saw the case as a test of free religious expression. Some conservative commentators ridiculed the case, saying it would be absurd to allow people to obscure their faces in ID photos.


Assistant Attorney General Jason Vail had argued that Islamic law has exceptions that allow women to expose their faces if it serves a public good, and that arrangements could be made to have Freeman photographed with only women present to allay her concerns about modesty.


"Nothing is more important than making sure that our people are safe, and (Thorpe's) good logic in making sure Floridians continue to be able to be safe is very, very important," Florida Attorney General Charlie Crist said Friday.


Freeman's lawyers argued that instead of a driver's license photo, she could use other documents such as a birth certificate or Social Security (news - web sites) card to prove her identity.


Freeman, a convert to Islam previously known as Sandra Kellar, started wearing a veil in 1997. She had a mug shot taken without the veil after her arrest in Illinois in 1998 on a domestic battery charge involving one of twin 3-year-old sisters who were in her foster care.


Child welfare workers told investigators that Freeman and her husband had used their concerns about religious modesty to hinder them from looking for bruises on the girls, according to the police records. The girls were removed from the home.
