Surprise surprise... I'm sure there will still be rioting over in Durham. This case sounded fishy from the start to me. The fact that she singled out the only black male for exempptoin who was supposedly there made me scratch my head. Looks like she was upset they called her some racial slurs and decided she would take some action.

Attorneys: No DNA Match in Duke Scandal

DURHAM, N.C. - DNA testing failed to connect any members of the Duke University lacrosse team to the alleged rape of a stripper, attorneys for the athletes said Monday.

Citing DNA test results delivered by the state crime lab to police and prosecutors a few hours earlier, the attorneys said the test results prove their clients did not sexually assault and beat a stripper hired to perform at a March 13 team party.

No charges have been filed in the case.

"No DNA material from any young man was present on the body of this complaining woman," said defense attorney Wade Smith.

The alleged victim, a 27-year-old student at a nearby college, told police she and another woman were hired to dance at the party. The woman told police that three men at the party dragged her into a bathroom, choked her, raped her and sodomized her.

Authorities ordered 46 of the 47 players on Duke's lacrosse team to submit DNA samples to investigators. Because the woman said her attackers were white, the team's sole black player was not tested.

District Attorney Mike Nifong stopped speaking with reporters last week after initially talking openly about the case, including stating publicly that he was confident a crime occurred. He went on to say he would have other evidence to make his case should the DNA analysis prove inconclusive or fail to match a member of the team.

Smith said Nifong now has the evidence needed to change his mind.

"He doesn't have to do it," Smith said of filing charges. "He is a man with discretion. He doesn't have to do it, and we hope that he won't."

Nifong's assistant said earlier Monday the prosecutor would not comment on the findings. North Carolina Central University, where the alleged victim is a student, said after the results were released that the prosecutor would appear at a campus forum on Tuesday to discuss the case.

Attorney Joe Cheshire, who represents one of the team's captains, said the report indicated authorities took DNA samples from all over the alleged victim's body, including under her fingernails, and from her possessions, such as her cell phone and her clothes.

"They swabbed about every place they could possibly swab from her, in which there could be any DNA," he said.

Cheshire said even if the alleged attackers used a condom, it's likely there would have been some DNA evidence found suggesting an assault took place. He said in this case, the report states there was no DNA on her to indicate that she had sex of any type recently.

"The experts will tell you that if there was a condom used they would still be able to pick up DNA, latex, lubricant and all other types of things to show that ? and that's not here," Cheshire said.

Stan Goldman, who teaches criminal law, evidence and criminal procedure at Loyola Law School in Los Angeles, said the DNA results don't mean that Nifong can't go forward with the case ? but the test results make a successful prosecution much harder.

"Isn't the absence of DNA evidence, given the way the victim has described the crime, in and of itself almost enough to raise a reasonable doubt?" he said. "That's all the defense has to do."

Robert Archer, whose son, Breck, is a member of the lacrosse team, said the test results only confirmed for parents what they already knew.

"I know the kids on the team and I know they're innocent," said Archer, of East Quogue, N.Y.

If this was a white stripper at Tallahasse and she said an African American Football player raped her at a party and ONLY the black players were tested for DNA. And she made it up!!!!

The players have pictures from the monent she arrived until she left. They took them because she came all beat-up, scratched, and drunk/high.

I'll tell you why I knew they were innocent. We are talking about 40 kids, most from wealthy families from the NE. NO WAY one of them doesn't rat out the guilty to save his own ass. The fact that there was not one peep this whole time just screamed that it was a lie. No way those richie rich fags down sing the truth if it were their ass on the line.

Too bad it cost the coach his job.

give it some time and every black politician will be using the race card here if these fellas are found innocent. mostly white school vs mostly black school. never no fear jesse is here. i am really shocked it hasn''t happened yet. but i think those quick to prosecute thought this was a closed and shut case. my how things change in a hurry. when ur star victim is a stripper, dancer, call girl or whatever u want to call here, plus she's on drugs makes u wonder.

i am wondering if the dr's checked her for drugs in her system? or her alchohol level. there is absolutely no way possible that no dna existed if she was gang raped like she said she was.

but i will wait until the prosecuter makes his move which should be very interesting, before i say one is innocent or guilty. but it sure does look like a fraud to me.

was just watching some stuff on MSNBC about the community hearing they had today in Durham and it made me sick......the way the black community has once again turned something that really shouldn't be about race into a hard core racial thing. One black guy at the forum rips the media for portraying, "my sista" as a stripper and not as a "mother, and student"....that's funny, I thought this case was about her being a stripper who may have been raped? Then the old black activist lady who told the police chief that if an arrest wasn't made by 5 o'clock tonight, she was going to personally call the FBI and report this "cover up" and report it as a hate crime? Go for it you dumb bitch....make your call!! The "bro's and sis's" don't like the way this DNA stuff turned out and the way the prospects for putting a few rich white boys in jail is starting to dwindle.......only one thing to do, let the phucking riots and looting begin!!

hell if u live in mich city they may riot there lol. by the way they still have the tug boat i mean gamblin boat thats in a moat there? havent been there in awhile but boy its a small one. did go to gary which was a mistake. like taking life into your own hands.

went to breakfast one morning in gary and proceed to watch a pick up truck come flying down the road with sparks flying behind it. the guy just ripped an atm mahine off its foundation and was dragging it with a chain down the road. craziest chit i had ever seen.

I live in Michigan City, and we actually had racial tensions errupt into small riots (this was many years ago) but nonetheless, the fuse is still here if you catch my drift. Yes, the boat is still here as well although it isn't small anymore, they just built a brand new boat.....same spot.....65,000 square feet all on one level....just opened a couple of months ago. As far as Gary, not good obviously.....I try to avoid it at all costs.....sometimes though I have to drive through there at night on my way to work if my primary route is blocked due to construction or an accident.....needless to say, I'm sweet talking my car the 10 minutes or so it takes me to clear the city. That is no place for a black person....let alone my white a##.

franky you need to visit gary sometime and see what its like. looked like a war zone last time i was there. used to be the number one crime city in the u.s. but i think houston has taken that over. not a good place for sure. old steel town that went too crap.

im sure the team was a big part of some of these kids lives,how can you just cancel the rest of the season,thats fkn stupid.if anything suspend the kids she pointed out,or the kids whos names are on the lease and go on with the season.id be pissed off.was the coach at the fkn party,what the fuk did he do wrong?she probably was asking for $100 dollars a fuk and got stiffed.

Now comes the best part. Earlier in the night they have a 911 call from someone for a person who is unconscious...well it turns out to be the stripper. She was knocked-out drunk earlier in the night before coming to and going to the players house. I'd love to see the DA try to establish some credibility here.

This is BS...the DA is up for re-election and he's doing this to get the black vote in Durham. Nice ****ing waste of our taxpayer dollars. She had semen in her but it was not from any duke player, she showed up with it. She came beaten up which the players have pics of proving it wasn't them, and no DNA match whatsoever, but that schmuck is going to still try to try this case. What a load.

I agree that it's pretty sketchy but i'd be interested in the explanation of how her torn off fake fingernails, money and cellphone ended up in the house after all was said and done. Have you heard any speculation on that, Saint?

Haven't heard anything that goes into detail about that down here, if I do I'll be sure to post it in this thread.
