John D. Bates was appointed United States District Judge for the U.S. District Court for the District of Columbia by President George W. Bush in December 2001. He graduated from Wesleyan University in 1968 and received a J.D. from the University of Maryland School of Law in 1976. From 1968 to 1971, he served in the United States Army, including a tour in Vietnam. Judge Bates clerked for Judge Roszel C. Thomsen of the United States District Court for the District of Maryland from 1976 to 1977 and was an associate at Steptoe & Johnson from 1977 to 1980. He served as an Assistant United States Attorney for the District of Columbia from 1980 to 1997, and was Chief of the Civil Division of the U.S. Attorney's Office from 1987 to 1997. Judge Bates was on detail as Deputy Independent Counsel for the Whitewater investigation from 1995 to mid-1997. In 1998, he joined the Washington law firm of Miller & Chevalier, where he was Chair of the Government Contracts/Litigation Department and a member of the Executive Committee. Judge Bates has served on the Advisory Committee for Procedures of the D.C. Circuit and on the Civil Justice Reform Committee for the District Court, and as Treasurer of the D.C. Bar, Chairman of the Publications Committee of the D.C. Bar, and Chairman of the Litigation Section of the Federal Bar Association. He was a member of the Board of Directors of the Washington Lawyers Committee for Civil Rights and Urban Affairs. In 2005, he was appointed by Chief Justice Rehnquist to serve on the U.S. Judicial Conference Committee on Court Administration and Case Management. In February 2006, he was appointed by Chief Justice Roberts to serve as a judge of the United States Foreign Intelligence Surveillance Court. (Ed. As a District Court Judge, Bates dismissed the GAO's effort to learn with whom Cheney's energy task force conferred.
On July 19, 2007, he dismissed a lawsuit filed by Valerie Plame Wilson and her husband against Vice President Dick Cheney, White House political adviser Karl Rove, former White House aide I. Lewis "Scooter" Libby and former Deputy Secretary of State Richard Armitage. Plame's lawyers had said from the beginning of the lawsuit that it would be quite difficult to win, since public officials and servants are generally immune from such suits filed in connection with their jobs. Plame's identity as a CIA field operative was revealed in a syndicated newspaper column in 2003. This revelation coincided with (Plame's husband) Wilson's criticism of the Bush administration's policy in Iraq. Many opponents of the administration question the timing of the leak of Plame's identity, and assign blame of the leak to officials in the administration. Although several administration officials were questioned in an investigation of the leak, no formal charges were brought, and I. Lewis "Scooter" Libby was then found guilty of lying and obstruction of the investigation as a consequence of his lying.

Judge Bates spent two years working for Kenneth Starr and the Independent Counsel's office during the investigation into President Bill Clinton, specifically Deputy Independent Counsel under Ken Starr from September 1995 until leaving in March 1997.

Lets just say. Wait and see. I would guess this will go to a 3 paneled appeals court. If there not all Reb's it might come out different. It could be a matter of timing also. Cheney still in office. Could be a change once he's out?? They don't want it to get to Supreme Court because it's gone to far right.

Well, it's certainly no surprise that a supporter of the war like yourself would not be disappointed there was no yellow cake...no big deal there, as long as we can justify a war with it, right?

Halliburton...let 'em eat yellow cake, eh? 'ol Dubbya and Dick's buddies are pretty much the definition of cake eaters in this timeframe, aren't they? Too bad the terrarists are now in Iraq and are pissing in the white cake of our soldiers, making real yellow cake. So now everybody can actually have their yellow cake and eat it, too. [ok, enough dessert (or is it desert?!?) references for one post]

Sorry, I know you're kind of kidding, but it's this ongoing flippant attitude symptomatic of this administration and it's war supporters that really gets to me. It's all like some sick joke for these guys, and the conservatives from Rove and his rappin' to Dubbya not thinking too much about Osama to McCain belting out "Bomb, Bomb, Bomb Iran" have told the joke too many times.

I think the outrage has gone on so long that we just expect this kind of thing to happen. Status quo in payback land. I think the only Bush guy who didn't really get the program was the judge in the Libby case, who clearly forgot for a moment who buttered his bread. If you stopped to list all the examples of this kind of thing in the Bush administration, Jack would have to shut down the forum or get a much bigger server, at least.

It wasn't Bin Laden it blew the cover of our CIA's agents, who are the real enemy? How many agents were killed because of this? Sheepeople of the United States still support the government of Bush. Like Texans who are proud of a justice system that kills them off faster than any other state whether or not they're guilty or innocent.

I think there is good reason to be concerned about how this came down - the people who were a part of this outing should be held accountable. I don't think that anyone should take this lightly, no matter what administration or "outers" are involved. It's at least arguable who was a part of this (we'll never know because someone was obviously hiding and forgetting a lot of things before convicted of such) and we need to have sensible protection for CIA agents of any denomination.

It's beyond reproachable why it was done, and if the truth were to ever come out - and not be hidden and then kept out of prison because of it - then we might be able to better judge how bad this situation was.

CIA agents have a lot of contacts across the world. They should be protected for plenty of reasons. Common sense should tell one that. For people so concerned about Patriotism and supporting our troops and information gatherers and providers to defend this is definitely open to riducule, in my opinion. Finally, whether anyone actually was hurt as yet by this is not the issue. Or it shouldn't be. Our CIA agents deserve protection, secrecy and latitude in their endeavors. Even if she was sitting at a desk for a while, some of her contacts probably aren't. To adamently presume nothing is at risk in this situation seems very short sighted to me.

As a federal judge appointed by Pres. George W. Bush, John D. Bates can point to another high profile dismissal of a nuisance case against the White House. In 2002 Bates dismissed a lawsuit brought by the GAO against Dick Cheney's Energy Task Force. Dick Cheney, as anyone knows who has followed his recent attempt to abolish a vital part of the National Archives, does not believe anyone else in America has the right to inspect any documents that cross his desk, and the GAO sued to get their hands on documents related to his Energy Task Force investigation. As part of the Whitewater team of "independent" prosecutors, Judge John D. Bates forced the Clinton White House to deliver thousands of documents concerning the Whitewater case over to prosecutors. Whitewater took place before the Clintons ever moved into the White House yet Bates and Starr denied their claims of executive privilege. Meanwhile, Dick Cheney was and is secretly withholding documents directly related to criminal investigations taking place while he is Vice President, yet Bates upholds executive privilege and blocks any attempt to uncover more information of wrongdoing in the Valerie Plame case.

Furthermore, Judge John D. Bates was appointed by the man Pres. Bush handpicked to server as Chief Justice of the United States for potentially another two decades or more, John Roberts, to the Foreign Intelligence Surveillance Court. This is the court that decides the legality of Pres. Bush's illegal wiretapping policies. Needless to say, John D. Bates has consistently ruled that Bush's wiretapping polices are completely within the boundaries of executive legality.

If one needs any more examples of why John D. Bates is patently unqualified to dismiss a case brought against the Bush administration consider this: Bates ruled that Pres. Bush could violate the Constitution by signing a bill into law that had not yet been approved by Congress! To have Judge John D. Bates decide the fate of a lawsuit brought against the Bush White House is as ridiculous as having the brother of a Presidential candidate put in charge of counting the votes.
