Selling Agent/Realtor help needed

I think some of you guys have experience dealing with realtors so I will look here before I put this lady thru the wall.

Signed the papers with her on 11 March to list my house. She sat here at my kitchen table and told me all the places I would have my house listed and blah blah blah.

The pictures she took of the outside of the home are atrocious. Who puts telephone poles in pictures?

Anyway, it has been 2 weeks now and she has not published the ad in places she said she would, AND the listing she does have is INACCURATE. Also, she has omitted many great selling points - new appliances, $5k towards closing, vaulted ceilings, etc etc.

basically she wrote - not a drive by, oak cabinets.

I took new pictures myself, gave them to her, wrote up a nice description of the house and gave it to her, and pointed out to her the glaring errors on various homelisting sites.

what do I get? nothing.
My 3 yr old kid could put together a better home listing with a crayon and one finger in her nose.

The contract I signed with her goes for 6 months, with the ability to terminate after 60 days of a written notice.

I need to end it now.
I need to sell this place and have lost any and all faith in her ability.
She didnt even list the house on her own website, and when I asked her why it wasnt listed there yet she said - oh, I am going to fire my assistant tomorrow for not doing it.

Seriously. that's what she told me. How gullible do you have to be to believe that?

So, my question is, how can I break this and not pay? Can I sit down with here and show her my logbook of "all things stupid" and we can mutually agree to end the relationship here and now and no harm no foul?

Or should I get ready to threaten to file a grievance with the State Realtors Board here?

MLS# aa5562964 is the listing number if you want a laugh.

Oooo, just looked it up... she changed it in the past 20 minutes since I fired off a nasty gram to her!

i had a similiar experience.......i went to the broker (the agent's boss) & told him i thought it would be fair to his business that i would talk to him before i contacted the attorney general's office.....i don't know how the commission was split ( & didn't care) but he gave me a different agent.....

i think it would be hard to break the agreement without trying other options first.....

roger that AR. That's what my goal is. Settle this BEFORE having to break the agreement. All I want is a new agent... but she's one of them crusty old ladies that will probably throw a fit...

The sneaky lady is going thru and redoing all the listings right now. I'm watching the various sites and seeing the ad suddenly change to different write ups and info and pictures.

Poor lady doesn't know I printed off screen shots of about 5 different sites that my house was or was not on and has now magically changed.
The way I look it at, I'm blowing 20 grand or so to have her list the house... she damn well better do a decent job of it.

it's unbelievable how poorly some people conduct their business.....

not to be cruel but it sounds like her time has passed.....

i would contact the agent first thing tomorrow....& wear your military uniform if you can....

All they need is a high school degree and a 4 day class to be a realtor where I am from. You don't get the smartest people ever, you get people who are too lazy to go to college and want the easiest job possible that makes money.

Obviously not all of them are like that but some are.

I have printed screenshots of realtor.com that shows my ad with no pictures.
I printed a screenshot of ALL HER LISTINGS that are on realtor.com and have pictures of the home.

I have printed copies of the ad from century21.com before and after she changed it with time/date stamps on it that can show how quickly it was changed after she got my nasty gram telling her I was coming in tomorrow to talk about the listing contract I have with her and how unhappy I am with her actions.

I have a 2 page log (in just 2 weeks) of times I contacted her to make changes or recommendations followed by inaction on her part.

I have printed screenshots of the listings on her own webpage that show all her listings... mine is not there...

I have the newspapers that my listing ad does not appear in.

Is it safe to assume I have my bases covered or am I going to need some more ammo?

No, great work. You definately have your bases covered. I would go in trying to be nice and let her know you want out and why. If she fights it use your ammo and get rude if need be. Obviously this relationship isnt going to work!

Marine...no offense but I just checked out the listing at century21.com and that picture sucks. Not only the telephone pole but also the garbage can and white plastic bag of trash as a bonus.

The description tells NOTHING about your home. You should have that fixed immediately. gl

rrc - yes, I know. She showed up the morning after I called her.. told me, no no no dont worry about anything just leave things the way they are, no need to clean up. Lucky for me it was trash day!

So she shows up and while i am signing papers with her, her dumb hubby is snapping pictures like a fan at a rock concert.. just hold up the camera and click.

I took one look at the pics posted.. grabbed my camera and went around and took better pictures and put them on a cd and gave them to her on march 14th.

think they would be posted by now?
2 showings in 2 weeks --- in an area that a home lasts 30 days on the market
yea... I'm just friggin delighted with this hag.

call her broker and explain all of your concerns. he has to try to resolve it. if you talk to the broker say your willing to let it expire if they wont send the cancellation notice for you to sign and you will send a written complaint to the dept of real estates commissioner. she can get her license suspended along with broker for misrepresenting what they would do. you have to follow through with what you promise as a realtor.
i see fellow realtors get slammed all the time for flaking out on clients.

I can give you the name and number of my realtor who is a personal friend of mine who will list your property, put out full color brochures, advertise it in every publication each and every week (very few do this because it's so expensive) - and I mean every one. Well, she works in DC, MD, and VA and sells them fast. DAMN! $203 per square foot? That is crazy to me for that style of house. Are you just outside Baltimore?

OK I'm a Realtor, and boy, their are some that give us a bad name. As your agent she and more importantly her broker have a fiduciary duty to you, that is clearly being violated, call the broker, tell him or her you want your agent changed today, or you will contact the real estate commission. Good Luck
