actually he didnt get a dui and was going 37 in a 25 zone (gee, i do that everyday)

the cops said he seemed to be under the influence to the slightest degree (what the hell does that mean)....well it means that they took blood samples and let him go home, in his car.

wont be weeks until the blood samples come back but sounds like a lot of nothing, except for the fact that he was out at 3 in the morning.....who knows what he was doing....coming home from a club or woke up from a friends house and decided to drive home.....if he wasnt on probation none of this is news, but since he is he likely will serve the full 8 games of his suspension and might have some questions to answer with bears mgmt

I believe he was told by the commish that a couple games would be taken off his suspension if he kept his nose clean. Maybe he consented to the blood test knowing there's nothing there.

Regardless of this, I never liked the way he went about the whole gun thing. His answers in public interviews were arrogant and stupid. If he didn't head to the club that night his "friend" would not have gotten murdered.

Doesn't seem like the guy is too sharp. If this incident is nothing, he'll blow it another way. He can't help himself.

...if its true the cops let him go and let him drive home there is no way he was legally under the influence...unless your dealing with stupid cops. Which is a possibility. and if it comes back as negative he will file a grievance. Although I am sick of this crap as much as the next guy with people that are given a million chances this may be a situation in which the Bears pulled the trigger to quickly.

apparently that question from bears mgmt was "what is your current home address, we need to privide it to the unemployment office"

not a total shocker that he got wacked by the bears and wont be a total shocker it his suspension is the full 8 games and maybe even more.......think the big issue was being out at 3:30 in the morning, even with the slightest use of alcohol he could have violated his probation and could end up back in the clink.......truthfully, where he belongs at this point.

Tob Quick? Sad we have reachd the point where anyone could even think this. I know you are talking about this particular situation, but honestly how many people on this board would keep there job if they went to jail on gun charges.

I am not talking about the Gun charges. if they had gotten rid of him at that point then fine...absolutely no argument at all. But they kept him and they kept him after he was suspended for first 8 or whatever games. Then they terminate him after he is pulled over for doing over 10 freakin miles an hour on speed limit and they dont know if he was drinking???????? That just seems counterintuitive. I understand your point in looking at the aggregate but I was talking about the termination based upon this incident. I dont shed any tears for this guy by any means and I agree with your looking at the big picture but it seemed from what I read that the reason they released him was because of "this incident." i just find it hard to fathom that you keep a guy after all the other crap which was much more egregious and then have an incident where the cops dont even detain him and let him drive home even though they thought there was a "slight" chance of intoxication.

again overall I understand your point and I feel the same way i just think they may have screwed up by not releasing him earlier and now they may be in a situation that the blood test comes back negative for alcohol and they released him. The Union will fight the release if that is the case..watch

this is ridiculous....not the fact that he got released by the bears, out at 3:30 in the morning after a few beers is enough for them to release him after what he's put himself thru......but why the fuk is he (or anyone) facing a "charge of impairment to the slightest degree" with a .07 bac....why fking have a bac level????

.08 is a joke as it is, but now states have the ability to charge you even when you are BELOW the bac?

I have seen them actually tru to prosecute when the driver is below the limit. Its a joke but thats what happens when you have stupid laws and overzealous prosecutors who cave into public groups and pass legislation on the heels of a public event which brings issues into the spotlight.

No one Please take this the wrong way I by no means advocate drinking and driving nor should we not prosecute individuals who are stupid enough to get behind the wheel of the car after having a six pack . but the legal limits in some states are just downright ridiculous and wish some common sense backed up by empirical scientific data would dictate what the limit should be.

Just to reiterate its absolutely ridiculous when i see prosecutors try and litigate a case against people who pass the breathalyzer etc..

Ex-Bear Johnson to avoid DUI charges

GILBERT, Ariz. -- Former Chicago Bears tackle Tank Johnson will not face charges connected to his arrest in this Phoenix suburb on suspicion of drunken driving.

Police said Thursday the case would be closed with no request for prosecution. Gilbert police spokesman Sgt. Andrew Duncan declined to elaborate.

"I am not surprised by this decision, but I am relieved," Johnson said in a statement released by his lawyer.

Johnson was arrested June 22 after an officer pulled him over for speeding and taken to the police station. He was released without charges.

Test results Monday showed Johnson's blood alcohol level was .072, under the presumptive limit for DUI in Arizona of .08 percent. That still left open the possibility of a drunken driving charge under an Arizona law that provides for such prosecutions based on overall signs and symptoms of intoxication.

The 25-year-old player was released by the Bears three days after his arrest. The team said it was "embarrassed" by the defensive tackle's legal troubles.

"I am still disappointed at having been released by the Bears yet I know the organization was placed in a difficult position when I was stopped by police," Johnson said. "Now I will move on to look for an opportunity with another NFL team, and make the most of it when it comes. In the meantime, I will stay in shape and spend time with my family."

Johnson already had been suspended for the first eight games of the 2007 season for violating probation on a gun charge when he was stopped by Gilbert officers. He spent two months in jail and was released in May.
