Here's the deal

Wife has best friend in from Nashville with 3 kids and husband.

yeah, I have SIX kids in house right now :scared :scared :com: :com:

anyway, I purchased a 20 inch LCD monitor for kids room upstairs, so they can watch tv. play PS2 and work on computer.

So Vernon (friends husband) tells me last night his son threw a matchbox car into the screen and now it has a spider crack in it.

It's ruined. He's said he willl buy me a new one before we leave.

I tell Tiffany (my wife) and she's like, "He should only pay you $370.00, since you go it on 'clearance"

I'm like TOUGH TITTY!!

If he can find me one just like it for that price fine, If not he's should fork out the $700.00+ to replace it.

I shouldn't be held responsible for the extra $400.00 and change b/c HIS kid ruined the monitor!!!

Homeowner's is $1000.00 deductable, so that isn't an option

why does he even know how much you paid for it anyway?

and kids do that stuff all the time. price of being a parent. its not like the kid did it on purpose.

gonna be in the minority here, but if it were me, he wouldn't "OWE" me anything.... if he volunteers to pick up some of the cost, not sure i'd turn it down tho. These are people "invited" into your home. Accidents happen, and kids don't think before they throw (unfortunately).... Say you have a big party right after installing new white carpeting, and a guest accidently spills sloe gin or something else that leaves a major stain on it that doesn't remove with cleaning... do they "OWE" you all new carpeting. maybe some think so, but IMO, i invited them into my house, it's my risk.

In law terms, he needs to "make you whole". That means he has to replace your TV....whatever the cost.

When you can turn on your TV and see the screen WITHOUT spider lines....you're set. Vernon's out some cash, the way I see it....or maybe he can turn it in to HIS homeowners policy. Check with Agent for details.

Accidents happen, and kids don't think before they throw (unfortunately).... Say you have a big party right after installing new white carpeting, and a guest accidently spills sloe gin or something else that leaves a major stain on it that doesn't remove with cleaning... do they "OWE" you all new carpeting. maybe some think so, but IMO, i invited them into my house, it's my risk.

i agree with you that if an "accident" happens in my home, that was caused by an invited guest - i would take responsibility - like the dropping of a sloe gin.

and yes, alot of kids don't think before they throw, but they will never think before they throw unless they are punished everytime they do it until they learn. throwing a matchbox car is not an accident. and i wouldn't say that it is a good analogy to the sloe gin dropping.

i know this didn't happen to you, but from what i gather - if you were the guest, and one of your children threw the item that broke the TV, i assume you would insist on replacing it - not taking "no" for an answer. am i correct?

or would you assume, it was just an unfortunate accident, and you didn't "owe" them anything?

he should get you the exact make and model, at whatever cost he can find it. sounds like he knows this, which makes things a whole lot easier.

would have been a very uncomfortable situation if he assumed it was just an "accident" (although i'm not sure how a matchbox car "accidently" whips across the room. it may not have been intended for the tv screen, but throwing metal cars indoors is a no no) and he says "oh well, real sorry about your tv".

if the kids were playing in the room, and one of his kids accidently trips over the tv cord and it comes smashing down on the ground, then yes, its an unfortunate accident, and i wouldn't hold it on anyone. i'd also be real happy that no one got hurt.

The burden is on him to replace the exact model you have. The cost of it, and how he gets it, is his problem. Maybe he will learn to parent his children a little better. Depending on the age of the child, sounds like he was a little bastard who should have known better.

Spilling wine on a carpet is no analagous. Throwing something intentionally is far different than accidentally spilling something. One has intent, one doesn't.
