"6. Take a breath, blood or urine test if one is offered. When your driver's license was issued, you agreed to take such a test if you were ever pulled over. It's called the Implied Consent Law and even if you don't remember agreeing, you did. If you don't take the test, your license will be suspended for a minimum of one year, even if you are not convicted of DUI. If you take the test and the reading is greater than .08%, your license will be suspended from 30 to 90 days."

I'm not sure if I agree with giving the sample. That's more evidence against you and it makes it harder to fight for your license back. :)

they are brutal out here in ca. you still see people gettin busted all the time. i wonder how much money the state makes? the people who lose loved ones due to dui should get some of that money.

One that always worked for me is when officer tells you to walk the line--just kinda squint at in for a monent--then look officer and reply "not without a net" :)

This might be a good idea in AZ... but here in NY the best thing to do if you think you're gonna fail is to refuse a breathalyzer. It's an immediate 6 month suspension of your license, but will save u points, time and money down the line.

Wox 11- yes, in California in 1984. I had pulled off to the side of the road and was sleeping. What got me was the key's were in the ignition. I had a jury trial. First one was a hung jury, second one was guilty.

Mjolnir- over 200,000 DUI's a year in California.

What got you was driving down the road under the influence.

Do cases like that normally go to a second trial? Never heard of that happening before.

IF you are going to sleep it off, you need to make sure you are not in the drivers seat and keys are hidden and not in the ignition, because you can't have the "capacity to drive." IOW, don't just put the car keys in your pocket, hide them somewhere where you will remember them, if that is possible. LOL

If you got enough money, and know the right people, you can get out of them.

Marine, you are 100% correct. The second trial is up to the prosecutor. It also cost me another $500.
