Sometime in the early 1970's my X and I were living in Detroit in this very cool apartment designed by Albert Kahn, you'd love it. We were smoking pot, drinking wine and listening to the new Allman Brother's album when the apartment buzzer rang. I looked out of the second floor window and saw a police car, back then we called them pigs, remember we were stone cold hippies at the time, lol. I pushed the intercom button and said hello. The voice on the other end answered, is this Gary? I replied yes it is. He said can I come up I have something to talk to you about. I said sure and I rang him up and then immediately yelled to my X. Flush the pot down the toilet we're being busted it's the cops, or pigs, I can't remember, lol. Then there was a knock on the door. Remember I'm pretty loaded on pot and wine. I open the door and standing there is a Detroit cop in full uniform. He asks, are you Gary? I answer yes I am officer. Well Gary I was in your neighborhood and I thought I'd drop off this book of Mormon for you..................holy shit can you believe that? I thanked him, shut the door and ran back to stop my X from flushing all our pot down the toilet.......I was late, it was gone. The very next day I started the excommunicating procedure.

Thomas P. Leary, president of Luzerne County Community College, struck a parked car with his college-provided vehicle and got out to examine the damage before driving away, according to a police report of the Nov. 2 incident.

The police report contradicts a claim that Leary was completely unaware he hit the parked vehicle and also noted two witnesses outside heard the collision in the parking lot of Theo's Metro restaurant in Kingston. The Citizens' Voice submitted an open-records request to Kingston and received the police report Wednesday.

Leary, 62, pleaded guilty Nov. 20 to a summary offense, leaving the scene of an accident damaging an unattended vehicle, and paid a fine that cost $407, records show.

"I have accepted responsibility for the incident which is documented through my plea. My statement of what happened is a matter of public record and I have nothing further to add," Leary said in an email.

The victim's vehicle, a 2006 black Volkswagen Jetta, was "properly parked in the spaces" when Sgt. Thomas McTague arrived at the scene 9:21 p.m. Nov. 2, and the four-door sedan had "significant damage" on its rear driver's door, rear driver's tire and quarter panel, the police report said.

"This collision with her vehicle also caused her vehicle to be pushed to the right," the report said.

Leary's vehicle, a black 2014 Honda sedan owned by the college, had damage to the passenger-side front bumper and headlight area, the report said. The victim's name is hidden in the report, and James Jeffrey Downs was listed as owner of the victim's vehicle.

The victim was working at Theo's Metro. Steven Hankey, another employee, told the victim Leary's vehicle hit her vehicle. Hankey was standing outside when he saw Leary and his son, Patrick, leave Theo's Metro.

After hearing the collision, Hankey saw Leary pull his vehicle forward and get out to the see the damage to the Volkswagen. A dispatch report at 9:17 p.m. said "party that hit the car was intoxicated - is no longer there."

McTague went to Leary's home in Kingston at 9:38 p.m. after checking the vehicle's registration and saw Leary's Honda parked with damage, and "nobody would answer the door at the time."


On Nov. 4, Kingston police Chief Michael Krzywicki told McTague that Bill Barrett, college director of security, called about the incident. McTague called Barrett, who said Leary contacted him Nov. 3 and "realized he hit something" after getting a call from the restaurant owner and seeing damage on his vehicle.

McTague told Barrett that Leary needed to come to the police station. McTague spoke to Leary about the incident Nov. 5 and asked Leary "about witness statements" his son was "possibly driving."

"I assure you I am the only person that drives my car," Leary told McTague.

Leary said "he got into the driver's seat," while his son stood outside "because the cars were parked close together." Leary said he "then backed up and hit the vehicle and then pulled forward and backed up to allow his son to get in the vehicle." Michael Spess heard the Nov. 2 collision outside his home on Sharpe Street, ran into the parking lot and saw the vehicle move forward. He then saw "the occupants exit the car and look at the damage," get back in the car, "back up again and exit the parking lot"

Barry H. Williams, chairman of the college's board of trustees, told The Citizens' Voice in November that Leary asserted he was unaware he hit the vehicle when he talked to Leary after the incident. On Wednesday, Williams said he will ask college Solicitor Joseph Kluger to review the police report.

Williams said he and Kluger reviewed the charge against Leary and college policies in November. They determined Leary did not violate terms of his contact or college policies, and Leary is allowed to use a college vehicle when working and during "off time," Williams said.

The board of trustees approved Leary's current contract in December 2011 and established a base salary of $155,000 a year. The contract also says the college will provide Leary with a vehicle "for the president's use" and will reimburse him for gas and auto-related expenses "based upon the policies and procedures in effect from time to time at the college.
