traffic ticket advice

last nite I was driving soutbound speed limit is 35mph . I saw 2 squads on my right so looked at speedometer was at 30mph. Got about 30 yards away and one of the squads was obstructing southbound lane so I slowed down went into northound lane and as soon as I was able went back into south lane traveling south. 5 minutes later get pulled over asked why cop says driving to fast for conditons. I ask how fast was I going he says 35mph. I ask if you have on radar he says no I estimated it. I said even if you say 35mph which was bs I was still going speed limit. I explained no way told him what I just wrote, It snowed here during the day yesterday this was at 10pm last nite and actually the road was just fine. I got a ticket when I looked at it later it was for failureto slow/move for emergency vehicle. No speed is indicated on ticket. Seems to me this guy told me something completey different than what I received the ticket for. Any advice from anyone would be greatly appreciated. Ticket is $263 3 points.

I have a friend/attorney/cheap......I'd find one like that if possible. Even if they charge you $200 bucks it's still a better deal. She got my improper turn reduced down to improper parking. I did have to pay a fine but no points, maybe this could work for you????? Good Luck.

Go to court.. #1 Be Respectful, Judges deal with Jackasses and Simpletons Everyday in Traffic Court so you'll be miles ahead just by saying Good Morning Your Honor etc etc...
If you actually moved into left lane, they have no proof of Speeding and your Driving Record is clean it will get Reduced to a minimal citation at worse..
If the Judge tries to lay the Hammer down I would plead Not Guilty and down the line the ADA will Plea it down to nothing before going to a Trial..

What State?

Wisconsin Washington county. Seems like its a he said she said but I am furious this is 2nd ticket in 36 years funny last one in same county speed limit was 25 I see sign ahead for 45mph sped up get pulled over cop says can't go 45 till you pass posted sign that wwas 4 years ago.

I dont have any connections in Wisconsin, however it may be worth telling your story to the Magistrate. Also, at least you can question the cop and make him lie on the stand. You have a right to ask him why he pulled you over and he shouldnt change his story, but he probably will. The only trick you may want to try is ask the officer, after he has changed his story in Court, this question, however be very very careful how you word this as you dont want to provide false tesimony either.

Something along these lines:

Hypothetically speaking Officer _______, what if I had recorded you on my smartphone, as I knew I was being pulled over would your testimony still be the same as you just testified too?

Giving him the appearance that you may have recorded the conversation, may make him double think lying again, but AGAIN this is a RISKY chance and may not be worth the $200, but if you want to fight it out, it may trip up Mr. Officer cause the last thing he wants is to lie twice and then have you play the recording, if you have it.

My waiver I am not your attorney and think you should consult a practicing attoreny in Wisconsin.

Just my thoughts.

thanks you know after the fact I thought why didn't I record this because I sat there for 32 minutes.

1 last question staue on ticket is 346.072 (1) (b) This is written as slow/move vehicle, maintaining a safe speedfor traffic conditions, and operate vehicle at a reduced speed until completely past the vehicle. Does this mean satisfy both or one of them?

Just asked a friend of mine who is a police officer in grant county. He said at this point its your word against officers. You should plead not guilty and take it to trial. They may offer you a better deal on the spot before you contest your ticket. If you like that take it.
If you do take it to trial and the officer doesnt show up (which happens alot) you will win.
Otherwise contact a lawyer in washington county and he should be able to tell you if he can get it reduced before you hire him.

challange the ticket, no need to get a lawyer, just a waste of money for a traffic charge. just explain what happened, it will get reduced or kicked out.
