hellah, it was insider trading but it wasn't her stock. Imclone I believe was the stock. I just don't get this though. My understanding is she dumped around $42K worth of shares. Is that enough to destroy her? It's my understanding her net worth has decreased over 800 million.

Some young punk is testifying he called her to tell her to dump her shares. Of course she's denying it.

She did lie to the feds about it so I guess that's why they are going to crucify her.

Should be interesting to see how this plays out.

This seems to me to be nothing more than a "witch hunt". I guess she did lie to feds about somebody tipping her off, but her broker told her that "hey the CEO is dumping all of his shares", I think I might be inclined to dump mine too if I knew the head of the company was doing the same.

I guess none of the 7 figure clients that these big brokerage houses have don't get tipped off before one of their analysts lower their rating on a blue chipper that is in one of their accounts. This shit happens all of time. I guess, beings she did lie about one of the details, that is why they are trying to crucify her. I think the feds are just trying to make an example out of her.

I have followed this case quite closely.

Martha sold 4,500 shares the day before the stock went down
because of a drug made by the company not being approved.
She was tipped the owner of the company was selling all of his shares.

Inside information its called. Then she attempted to cover up
and deny what she had done. She considered changing phone messages and having them change their stock records to show
a sell order if stock dropped to 60 a share.

Then she lied about it to the FBI and others.

At one point she said to investigators.... I havnt got time for this
I have a business to run.

Oh Martha thats not too good.

She made about 55K by selling all her shares one day before it dumped. The total value of the shares were 225K.

This has really hurt her Martha Stewart company holdings.
But don't feel too sorry for her as she is worth in the neighborhood of 200 million.

If this was average american would get 10 years jail.

I would have to say money talks and Martha walks.

The average american wouldn't be on the stand.

As an example, Cheney has never gone on trial for dumping his shares of Halliburton before it tanked , let alone Dubya for selling his shares in Harken right before Kuwait was invaded and the Company's assets were destroyed.

But I do agree w/ Dubya, Let's get the crooks!!!

I think Scott may have called this one.. I heard she had a stop-loss anyway.

It's a shame how they can expend all efforts for Blue -Collar crimes, and meanwhile repeat offenders are let loose to do what that creep did in Florida.

They could not nail the big fish from Enron a big Bush supporter.
So they said lets nail this gal she a Dem is she not. I guess she said more Indepentent then Dem but close enough. And she is not charged with insider trading. They said she lied in her interview with the Fed's. I dont care what they do with her. But she is a smallfish compared to the folks there letting get away with millions.

"The security fraud count, the most serious charge against Stewart, accuses her of propping up the stock price of her own company, Martha Stewart Living Omnimedia, by claiming in 2002 that her ImClone sale was proper and that she was cooperating with authorities.

Securities fraud carries a potential 10-year prison term. Each of the other four charges against Stewart carries a five-year term. If convicted on any count, she would likely get much less than the maximum under federal guidelines."

I have a hypothetical question for you.

Go back 10 years.

If you personally somehow were able to be involved in a Haliburton type situation where you could bend the law and take advantage of a business venture maybe by charging extra for oil barrels.

Your company has lawyers so chances of any prosecution would amount to possible fines and probation.

By making the decision you personally stand to gain in the neighborhood of 2.5 million dollars after taxes.

At this stage in your life you would have a net worth of
say 780k including mortgage on the house and all other assets.
Retirement looms ahead.

There are alot of layers ahead of you that would have to go
down before you did. Business is business.

Would you do it ?

SA, I think it's what your about inside and how you were brought up. I remember lieing about my age to get my first job delivering papers for 2 bucks aweek. You had to be 12 I said that. But was only 10. I guess they should have put me in jail. My family didn't have much. So 2 bucks in 1952 was worth what. Lots.
Then I did it again lied about my age to work at this service station for 50 cents a hour. You had to be 16 I said I was. But was only 15. My father gave me alittle working over for that lie. Back then a little working over was no samll thing. He made me go to the man and tell the truth. Guess what the man said. Kid for that you have a job anyway. You can sweep the floor and wash cars and you dont have to be 16 to do that.
I would with by basket so full of doe not tell a lie to try and be greedy. I understand from that lesson a long time ago the truth wins out.
