my lovely ex wife made more money than i did last yr and yet got close to 40 percent of my income until i went to court to get it changed.i did thankfully get it lowered but she shows judge a dental bill from last nov for our 3 yr old son.judge decides i should pay 40 percent of 600 bill.well i call dental office to inquire about what work was done{i was not aware he went or had to have any work].dental office tells me they can not release any info because of the privacy act.i am so pissed at judge i am going to file papers to go back to court.the bottom line is if your a divorced dad you get screwed on support and visitation rights.

HIPPA (privacy act) does not apply to you since you are one of the dependant child's guardians. You are paying child support so u do have those rights (That's my understanding at least although I could be wrong). Your wife must have said you weren't around or something, or when she was filling out the paperwork, she did not include you in the information as somebody who is allowed information. She needs to start always doing that when healthcare issues for your child are involved.

What in the hell could a 3 year old need 600 dollars worth of dental work for??? I would highly question that myself.

Sorry for your troubles, bro! I hate to hear stuff like that.

SixFive is right, you have a right to your child's records because you are the parent. Your ex-wife neglected to inform them of this, i would get that changed.

As far as your child's 600 dollar bill, i've thought about it a bit and things can add up pretty quick. For 1 really decayed tooth, the bill can run easily like...

That's about 550 so it adds up quick for 1 tooth. I'd get on your ex's ass for letting your kid's teeth get that bad. I mean seriously, brush. Lowell is your kid on well-water. If so you need to get it tested for fluoride and get your kid on fluoride supplements if necessary.

I could write for days about the same kind ofshit that happened to me. Guys don't stand a chance in court. Isn't it really nice to know that sex discriimination is alive and well in the justice system. Its all a big racket and a popularity contest between attornies. The laws state that you are supposed to do whats in the best interest of the child. Hardly ever works that way. Gotta quit, as I am about to run my fingers through my keyboard right now thinking about this stuff.

thanks guys.no saint he is not on well water but he may not drink enough water.he is always drinking juice.i just took him to the beach last week and he caught his first fish.that was the most fun i have had in sometime.having a child is wonderful.fighting to see him is tough.

AND, not only does he not have to FIGHT to visit the kids, i need to FIGHT to get a weekend off every once in a while!!!

I'll do my dentist duty of the day and advise you to cut back on the juice if you can. Especially if he constantly has a sippy-cup in his hand, he'll constantly be coating his teeth w/ sugar. Ideally kids his age should only have about 6oz of juice a day, which amounts to about half a cup. I hate to sound like I'm lecturing but if he/she has had 600 bucks worth of care at age 3, there are a lot of problems that will happen if you let it continue.

Good luck with everything, at least the weather here is getting nicer huh?!

yep Jack, you're reading it right.... the useless piece of chit is 26,846.24 IN ARREARS!!!!!!!!!

we have been divorced for 8 years and his monthly obligation for TWO kids is only $455.00.


i would have him sent to jail for the arrearages, but what good would that do, he can't work when he is in jail (which he is 50% of the time anyway....LOL) and all the total does is build even more. the way i see it, is i could still be getting back child support when the KIDS are collecting social security :p

There are those dads that just make all men look like chit. And of course there are those gals that can be very clever. The folks who love it are the lawyers. I swear they just try to keep both side pissed as long as they can to run it up. And in some cases both guys and Gals should step back see what the cost is for the lawyer vs the dental or doc bill. And in the long run everyone should step back and remember the kids. After all it's not there fault.

thanks saint.he only drinks organic apple juice and milk with me.bet chapel hill is beautiful right now.next few weeks we could lose marvin,jr,deng and livingston to pros but i hope they all stay.i may go see acc tennis tourney in raleigh this week-end.unc men are playing well.their coach-don johnson is a fine person.few yrs ago his doubles partner on the tour was from india and got don and his wife to spend months working at orphanage hospital for dying kids that mother theresa set up for children in india.

mama- you need to go to the inforcement unit where you live ;) if he is incarserated SP? his bail will be set at the amount of the arrears...........F*K him

go seek some sympathy somewhere else , because any decent father follows the rules of the courts which is 40percent in your case ...........ah geeeez does that take away from your gambling habits ??????????

Tara.... it does me no good to go to try and have him imprisoned for non payment of support. his life history says that he doesn't give a crap if he's in jail or not and it is partially due to his time IN jails/prisons that he isn't employed. (and when he isn't employed, they can't garnish his wages for current and back support)

for the past 5 months now, he is out of jail (but under a basic house/work arrest, and forbidden from being around any children under the age of 16) at least during these months, we are FINALLY getting some support aid for the first time in 4 years!!!! (and they are even collecting a whopping $35 per month from him for the 26K+ arrearages.....LOL)



my main defense against him now is the fact that he can't get a drivers license back until *i* give permission for it (even tho at the end of this month he would be eligible for it as far as the law is concerned.).....thing is...once he is off parole, he can *quit* his current job with no consequences.....hell, no drivers licence, NO transportation to and from once he is allowed to move back in with his GF. as soon as he quits, it once again means no more child support :(

as far as *medical/dental* bills go...... even tho he is responsible for half (per divorce decree) i have never submitted any proof of bills to the county agency responsible for withholding the support from his paycheck........ when i do, those arrearages go up about another $4K

IO .... there are no good guys or bad guys (or good gals or bad gals) as a whole..... everything is individual cases, but the thread started out saying that men are the ones getting screwed in child support issues and that isn't ALWAYS the case ;)

We will see where this goes. From my experience, the story comes across differently from the two parties involved. Time may indicate things. That's all I have.

Bahama is exactly right in that each case has its own individual characteristics and circumstances. Her X is what makes it hard for the dads who are truly trying to do what is best for their kids and be a part of their upbringing. Alot of women, not all, use the courts as nothing more than an oppurtunity to fill their pockets with as much money as they can, and unfortunately, under the current structure, they don't have much of a problem doing so. The mediator that we had to go to (who was an attorney) told us that the guy who developed the formula that a lot of states use to determine how much the secondary parent must pay, finally admitted that it was not right. He did not take into consideration alot of the expenses incurred by that person, such as life insurance, health insurance, utilities, etc. Has it been changed??? NO

I'm sure there are many women in the same shoes as Bahama, and that is sad. Its not a good situation for anybody.

Best of luck to you Mama, I'm sure its not a pleasant situation to be in. Atleast you get to see your kids on a regular basis, my daughter lives 800 miles away.

(and if all of you do want to look at the *evil* female side in court during divorce.... in a round about way i was *evil*.....LOL)

based on his income at the time of the divorce, i could have been awarded about 900 per month in support, but i know his history of holding a job, and went for a FLAT amount rather that % of income, which meant in the long run that his balance due keeps accumulating rather than coming to a standstill during his *hard times of unemployment due to being in jail* <<<<heavy on the sarcasm. :D
