Dog attack advice

recently my golden was attacked by a pit bull while getting off the elevator in our condo.

my dog did nothing but take one step out of the elevator where there was an agitated pit bull who just had a confrontation with another dog further down the hallway. the incident is on our building security tapes and confirms everything above. i had to take him to the emergency vet (since it was 9pm) and to a subsequent vet visit and the total costs are $500.

i've talked to the woman who owns the dog and she seemed willing to "talk" about the bills but has avoided me since.

my question is; are there any lawyer types out there who can tell me if i have any legal recourse against her if she doesnt willingly help pay (and in my mind, help pay means pay the entire fuking bill)?

thanks in advance for you answers and advice and fwiw......my dog is fine, but has been limited in his activities (walks, no pool or running on the golf course at our desert house) and still has two slightly open woulds that are being treated with anti-biotics.

I'm no lawyer, but if the incident is on tape I think you've pretty much got her by the balls. Hopefully she will step up and do the right thing, but if she's like most people she won't.

I don't think there are any laws on dog on dog attacks it has to dog on human to have a case to take to court.

You can definitely sue in small claims court for dog attacks on another dog. I've seen it on People's Court many times. :SIB

If your dog knows how to use the elevator, you should seek far more than the $500.

Now, if you don't, get an alibi have have the dog whacked. I guaran-damn-tee you that's what I would do!

Got me a Pomeranian now so I belong to the dog owners club!!!

I have been told by local PD
that carrying a telescopic baton is OK,
reason being your fear of dog attacks.
Now you have a reason. I always have one
when I walk my dog.

Sorry about your dog but very GLAD he/she came away with minor injuries.

My neighbor lost her calf muscle to a pit bull while walking on the side walk.

I'm sorry but I have no sympathy for these dogs. They are bred this way. It isn't their fault but what do you do?

That and people with loose boa constrictors in their house with infants... :nono: Happens in Florida three times a year.

Was your dog on a leash?
That could go a long way in a judges eyes.
Small claims is where you are headed.
Give her a copy of the vet bills and tell her she can make payments if you want to keep it out of court.
Just get a signed statement every payment for proof.

I would send her certified letter restating events of attack on your dog and noting survailience tapes and you will be saving copy of letter in case in the probabilty that her dog will attack another dog or someone again--you will give letter of warming to next victim as proof she ignored previous warnings--in event of litigation against her.

I don't know about this lady --but if I were in her shoes--I'd be delivering you check for your vet bill over lunch paid by me while your dog was getting pedicure on my tab. :)

Small Claims court perhaps, would give hear a copy of the bill or slide it under her door or put in her mail. Get paid, and then it would be bye bye to that Pit Bull.

Sure hope I never have to experience this, because even though the Pit Bull might grab one of mine, the other would kill it and I would let it happen. Good luck.
