if an internet site says they do NOT disclose any info on you to any third parties...is there any recourse if you can prove that they did??

Absolutely. If you can determine which jurisdiction to bring the action in you can sue them if you can establish that you were materially damaged.

here is more about the situation....my *aunt*, (96 years old) who has NEVER EVER used a computer in her life.......well, she shows up under her legal name (rather than the name she has used all of her life) on ANYBIRTHDAY.COM ..... as of this point, it is an assumption, but i WILLLLLLLLLL find a way to prove it, but Turbotax.com has given out this information (i did her taxes there last year)

hmmm...now i see the edit with the materially damaged thing.......all it would ever cause her is stress if she were to find out i saw her listed on an internet site (and i don't plan on telling her)

mmmm...I'm sure you are right, but I'm not sure that constitutes "legal proof". also, you will have to show that you have been (or rather your "aunt") materially damaged in some regard, and that might well be impossible in this instance.

Very annoying, I agree, but I don't think it's worthwhile to pursue. I'm no lawyer, but the cost of investigating further probably won't be worth it.

Hey, I know, why not hire a hacker to screw their web site up?? Sometimes revenge is the best approach.

countinguy...don't take what i said wrong :) yes, she knows what a computer is (but has never touched one or put any info into any computer) when i said i wouldn't tell her that her name and birthdate appears on ANYBIRTHDAY.COM, i meant if she could only sue turbotax.com's @sses if material damage could be proven.

Obviously, she in no way has been damaged by this materially, but she would be PISSED if she knew she was on the internet....LOL

(some of you guys may remember this story, but she was the math teacher that was gonna flunk roger craig in junior high school and make him ineligible for football....LOL) geez those tutoring days that i remember so dearly :D

oh, and the reason i use aunt in parenthesis, is that she is not blood related.......... she helped raise my mother when my grandfather died at a youg age, and has always been known as *Aunt Mel* to me (and anybirthday shows her as *CLARA*) which has only been used in ONE place....that place being turbotax.com

Let me restate that. "I" don't think it's OK. It's scummy, pathetic, fraudulent behaviour, because they are financially benefitting from an action they promised you they wouldn't do.

However, the test in law is: Were you damaged?

The Advertising Standards Authority and BBB's I'm sure will be interested, but not from a criminal angle, more from a cease and desist order.

They are just conmen who can get away with it unless you hack into and annihilate their site!!

Let me know how it works out.

LMAO chan.....couldn't belive it myself that i would ask such a question of Eddie ;) ......and true, this is a NO DAMAGE DONE situation unless i tell her that i found her birthdate info online....if she were to find out shit WOULD hit the fan right in my face for using the internet to do her taxes ;) thing is it just pisses me off that a site you think you shoud be able to trust discloses personal info.

*I* was damaged because my *aunt* has now cut me out of her will since i released her personal info to the internet in generel....LOL ;)

Ok, now we are talking. All you have to do is to establish a contingent liabilityto your "aunt". What I mean is, could Turbo Tax have been reasonably expected to accept the liabiliy associated with the potential of your aunt's reaction.

In other words, TT cannot be held liable for contigent acts arising from thire wilful disregard for their initial promise. If they were, the entire world would go crazy.

go after them on the grounds that:

They profited from selling your aunt's personal information to a third party.

Obviously they get money for selling contact lists to other vendors. They made money off of your aunts info.

Sue them on the grounds that you are not a whore and never gave them permission to use your info for their profit only purpose with no intentions of goodwill.

End result, you are now flooded with spam and email messages because anybirthday, in turn, sold your info to other parties.
cant work because you are sifting thru email bombs in your inbox for an hour a day.
