you can spend the money to take him to court, he won't show up and you get a judgement. a judgement and $.50 will get you a cup of coffee.

the only way he pays back on a judgement is if he has good credit but if he had good credit he wouldn't have gone to you for a 10% personal loan.

i haven't really been following this thread...but will follow-up on jack's post....once you get a judgement against somebody you can go after their bank accounts or pay or hand it over to a collection agency....

i had a $6000 judgement against the builder of my house and i couldn't go after bank account, pay or anything.

i did go back to court when he wasn't paying and the jusge gave me a lien on one of his houses. i was in about 30th place on that deal so wound up with my dik in my hand.

geeze, that sucks!! I once went to court and got a judgement. I realized pretty fast that it wasn't worth the trouble I went through and impossible to collect.

i don't know jack...i once had a problem with a tenant who ran out on a lease & did damage to the rental...took him to court & got the judgemnt & after him not paying i then went after everything that i could...& got it including the fees that my attorney charged me....maybe it's different in each state...

maybe because my judgement was vs a LLC and not personal? :shrug:

he wound up going bankrupt and i got a list of all his creditors along with all the other legal paperwork in case i wanted to go to court and argue my position. i think you were on the list too because evrybody else in the country was :mj07:

he had like 4 amex cards owing over 150k on a 4 page, 3 column document listing all the creditors. man, that guy screwed everybody. glad i didn't get fcuked like most of the people on that list. wow :scared

there are also many stories out here about builders ripping people off..it's a shame....
